المستخلص: موضوع هذا البحث هو العلاقة بين الحاكم والمحكوم في الإسلام، وكيفية ضبط هذه العلاقة من خلال هيئة أهل الحل والعقد، لكون هذه الهيئة تمثل حلقة الوصل بين الحاكم والمحكوم، ومركز الثقل في النظام السياسي الإسلامي. وأما أهدافه فهي بيان واجبات الحاكم والمحكوم في الإسلام، وبيان معنى أهل الحل والعقد، وبيان أثرهم في ضبط العلاقة بين الحاكم والمحكوم. واستعمل الباحث لتحقيق ذلك المنهج الاستنباطي، والمنهج الوصفي، والمنهج المقارن. وكان أهم النتائج: أن الإسلام نظم العلاقة بين الإنسان وربه، وبين الإنسان وبقية أفراد مجتمعه، وبين الحاكم والمحكوم، وبين الدولة الإسلامية وغيرها من الدول، فهو دين شامل لجميع أمور الحياة. وأن على الحاكم عدة واجبات منها: حفظ الدين، وتنفيذ الأحكام بين الناس بالعدل، وإقامة حكم الله في الأرض، وحماية حدود الدولة الإسلامية. وأن الإسلام أوجب على المحكوم عدة واجبات منها: البيعة، والسمع والطاعة، والنصيحة. وعدم الخروج على الحاكم الشرعي إلا في حال الكفر الأكبر وفق شروط وضوابط معينة. وأن الحكم بالقوانين الوضعية، منه ما هو كفر أصغر، ومنه ما هو كفر أكبر، والذي يحدد ذلك هم أهل الحل العقد وليس عامة الناس. وأن أهل الحل والعقد هم الأمراء والعلماء ووجهاء الناس. وأن نظام أهل الحل والعقد ومنهم أهل الشورى يوافق الأنظمة السياسية الغربية في بعض الأمور ويخالفها في أمور أخرى. أما أهم التوصيات فهي: العودة إلى المصدرين الأساسيين: الكتاب والسنة، والصدور عنهما في كل الأنظمة والتشريعات. وأهمية نشر فقه السياسة الشرعية بشقيه: العلاقة بين الحاكم والمحكوم، والعلاقة بين الدولة الإسلامية وغيرها من الدول، عبر وسائل الإعلام والمدارس والمعاهد والكليات والجامعات والمساجد. وعدم إشغال المحكومين وبخاصة الشباب بالسياسة ومتاهاتها، وملء فراغهم بما ينفعهم في أمور دينهم ودنياهم، وترك أمور الأمة العامة لأهل الاختصاص وهم أهل الحل والعقد. وأهمية قيام العلماء بمهمتهم فيما يتعلق بنصيحة الحكام، وإرشادهم، والإنكار عليهم في حال وقوع المنكر، بالطرق الشرعية. وعدم التسرع والتوسع في التكفير لعامة الناس وللحكام بخاصة، لما يجلبه من شرور وفتن ومصائب على الأمة، ولما يؤدي إليه من عواقب وخيمة على الإنسان في الدنيا والآخرة.

The subject of this research is about the relationship between the ruler and the ruled in light of Islam, How to adjust this relationship through the representative of people matters, and they represents the link between the ruler and the ruled, and its objectives is to state the duties of the ruler and the ruled in Islam. The researcher used to achieve this research, the deductive approach, the descriptive approach, and the comparative approach. The most important results: - Islam regulates the relationship between man and God, between man and the rest of society, between the ruler and the ruled, and between the Islamic state and other states, so it is a comprehensive regime for all things in life. - The ruler has many duties including: keeping the religion, the enforcement of sentences with justice between people, establishes the rule of Allah on earth, and the protection of the borders of the Islamic state. - Islam obliged the ruled many responsibilities like: the pledge of allegiance, obedience, and advice. - The inadmissibility to go against the ruler except in the case of committing a major kufr according to certain conditions and regulations. - Ruling by the Man-made law instead of Islam is considered either a minor Kufr or a major Kufr, and the representative of people matters has the power to determine that, not the common people. - The representative of people matters are the: Princes, scholars and nobles people. - The regime of the representative of people matters including the Shura agrees with the Western political systems in some cases and disagrees in others. The most important recommendations are: - Rule the Islamic state with only the Quran and Sunnah, and elicit all regulations and legislation from them. - The Importance of spreading the jurisprudence of Islamic politics for both: The relationship between the ruler and the ruled, and the relationship between the Islamic state and other states through the media, schools, institutes, colleges, universities and mosques. - The common people should stay away from indulging themselves in politics matters because it is the duty of the representative of people matters. - The importance for the Religious scholars to Carry out their duties as to advice the ruler and denounce them if they fall into something contrary to Islamic religion. - Not to rush to declare someone a disbeliever especially the rulers, because it might cause agitation between people And the resulting of serious consequences in this life or in the life after.
