يهدف البحث إلي التعرف وتحديد المسئولية من منظور الشريعة الإسلامية والقانون الوضعي المصري عن المخاطر الجسيمة والوفاة في المنافسات الرياضية وذلك من خلال: - المبادئ الإسلامية الآتية:"التابع تابع لغيرة في الوجود يتبعه في الحكم-الجواز الشرعي ينافي الضمان"،"لا مسئولية فيما هو جائز شرعا وتم استعماله باحترام الغرض الاجتماعي"،" المتسبب ضامن إذا كان متعديا"، "المباشر ضامن وإن لم يتعمد"-المباشر من يحصل الضرر بفعله ومن ثم فهو ضامن سواء كان عامداً أو خطئا،"إقامة العدل والمساواة". - تحديد صور الخطأ المعاقب عليها في المنافسات الرياضية (الرعونة- عدم الاحتياط والتحرز- الإهمال والتفريط-عدم مراعاة اللوائح). *أستاذ ورئيس قسم تدريب الألعاب الرياضية- كلية التربية الرياضية للبنين بأبي قير- جامعة الإسكندرية. * أستاذ الإدارة ورئيس قسم الإدارة الرياضية – كلية التربية الرياضية للبنات-جامعة الإسكندرية - القصد الجنائي ودرجته في المنافسات الرياضية. - تحديد أركان المسئولية"الخطأ-الضرر. - علاقة السببية بين الخطأ و الضرر. - الإصابات الرياضية وأنواعها ودرجة شدتها حتى الوفاة. - أحكام المسئولية والإعفاء منها:عند الحوادث والإصابات في المنافسات الرياضية"من المنظور والمبادئ الإسلامية أو الشريعة الإسلامية والقانون الوضعي"المدني والجنائي". استخدام الباحثان المنهج الوصفي المسحي,والتحليل ألارتباطي ،ومجتمع البحث المنافسات الرياضية المختلفة سواء فردية أو جماعية،حصر إحصائيات خاصة بالحوادث في المنافسات الرياضية ومنها أدي إلي الوفاة. أدوات جمع البيانات المستخدمة: استمارة استبيان من تصميم الباحثان مع المقابلة الشخصية-مع الاعتماد علي المراجع ونتائج الأبحاث والإحصائيات المحلية والدولية للحوادث في المنافسات الرياضية. ومن مناقشة وعرض النتائج واستخلاصات البحث أوصي الباحثان بوضع نموذج للوعي للمنظور الإسلامي والقانون الوضعي لتحديد المسئولية أو الإعفاء منها عند المخاطر والحوادث الجسيمة أو الوفاة بتحديد الأحكام للمسئولية المدنية والجنائية في المنافسات الرياضية وفقا للشريعة الإسلامية واسترشادا بنتائج محاور الاستبيان الخاص بالبحث. \
The study aims to recognize and determine the responsibility of Sharia and the Positive Law Perspective In Facing The Enormous Hazards and Death in The Sports Competitions through: -Islamic principles , the vassal follow the other in the existence, follow it in the judgment, the legal legality contradict with liability and it was used with the respect of the social purpose, the causer is the guarantor when he is the committer , the doer is the guarantor even he is not the premeditator ,the doer who caused the detriment, so he is the guarantor if he is the premeditator or not, institute of justice and equity. - Determine mistake shapes which will be punished in the sport competitions(frivolity- incaution - negligence and forfeiture- contempt of regulation) - Mistake criteria and its degree in the sport competitions. • Head of the Administration Dpartment, Faculty of Sports Education for Men, Alexandria University ** Head of the Administration Dpartment, Faculty of Physical Education for Girls, Alexandria University — Determine responsibility basis "mistake-detriment- the causal relation between mistake and detriment — Sport injuries- its kinds and intensity to death — Rules responsibility and discharge of it: in accidents and injuries in the sports competitions from Sharia, Islamic principles and positive law "civil and criminal". The researchers utilized the descriptive survey method and correlated analysis , the research community is different sports competitions -team and individual — Counting the statistics of accidents of sports competitions which lead to death Data collection tools: A questionnaire with interviews designed by researchers with depending on references , researchers results ,local and international statistics of accidents of the sports competitions. After discussing results of the research , the study recommended to sit a model of conscious of Islam perspective and the positive law to determine responsibility or discharge of it in facing hazards or fatal mistake or death by determine rules of civil and criminal responsibility in the sports competitions according to Sharia and by guiding of results of questionnaire related to the study, \
