المستخلص: This research includes the permission allowing to act by indication instead of explicit permission. The study consists of an introduction, three chapters, and a conclusion. The introduction consists of the importance of the subject, its objectives, difficulties, study boundaries, methodology and the study plan. The first chapter includes studying and authenticating the Shar'i permission by defining the permission, and the most important linguistic differences of permission with others, then the types of permission and its conditions, then how the permission will become indication? Its means? Who has the right to this permission? When will the permission be revoked? When will the disposition of the permission be invalidated? The Shari’ provision of permission. The second chapter deals with studying and authenticating of the indication by defining the indication, the most important linguistic differences of the indication with others, its kinds, and types, the faces and meanings of the indication, the non-verbal indication, then the conditions of the indication versus the declaration. The third chapter deals with studying and authenticating for the permission indication defining as a composition of permission and indication, the main differences between explicit permission and indicative permission, the statement of scholars about indicative permission and then the important rules that include permission is indicative and include its provisions. The fourth chapter includes the applications in which permission to act in fact, shows an indication, in which there are up to fifteen stable applications derived from various books to clarify and facilitate the concept of permission as an indication.

يتضمن هذا البحث الإذن المجيز للتصرف بطريق الدلالة، المقابل للإذن صراحة، وقد انتظمت دراسة هذا البحث، بمقدمة وثلاثة مباحث وخاتمة، فالمقدمة، فيها أهمية الموضوع، وأهدافه، ومشكلاته، وحدود الدراسة فيه، ومنهجه، وخطته، كما شمل المبحث الأول: الدراسة والتأصيل للإذن الشرعي بتعريف الإذن، وأهم الفروق اللغوية للإذن مع غيره، ثم أنواع الإذن، وشروطه، ثم بم يكون الإذن دلالة؟، وما هي وسائله؟، ومن هو الذي يحق له هذا الإذن؟، ومتي يرفع الإذن، ويبطل التصرف في المأذون؟، وحكمه التشريع من الإذن، أما المبحث الثاني: فدراسة وتأصيل للدلالة بتعريف الدلالة، وأهم الفروق اللغوية للدلالة مع غيرها، ثم أقسام الدلالة وأنواعها، ثو أوجه الدلالة ومعانيها، ثم الدلالة غير اللفظية، ثم أحوالها مقابل التصريح، أما المبحث الثالث: فدراسة وتأصيل للإذن دلالة، بتعريفه مركبا من الإذن والدلالة، وأهم الفروق بين الإذن دلالة والإذن صراحة، ثم أقوال العلماء في الإذن دلالة، ثم أهم القواعد المتضمنة للإذن دلالة والمتضمنة لأحكامه، أما المبحث الرابع: فتطبيقات يظهر فيها الإذن في التصرف بالفعل دلالة، جمعت فيها ما يصل إلى خمسة عشر تطبيقا مستقرا من بطون كتب الفروع غايتها التوضيح، والتسهيل لمفهوم الإذن دلالة.
