يعالج هذا البحث موضوع منظمة دولية إقليمية جديدة أنشئت في نهاية عقد التسعينات من القرن الماضي في أفريقيا وصنفت آنذاك كبديل افضل وأقوى من سابقتها وهي منظمة الوحدة الأفريقية، وفي بحثنا هذا سنتعرف على الظروف التي رافقت أنشائها والتي يصنف بعضها كرد فعل على سلبية منظمة الوحدة الأفريقية من بعض القضايا الرئيسية في القارة السمراء سواء تلك المتعلقة بفشل برامج التنمية من تحقيق مبتغاها رغم ضخامتها ماليا وإداريا، أو من جهة تعثرها في التدخل لفض المنازعات الداخلية والإقليمية على حد سواء حيث شهدت القارة حروب أهلية مزمنة وانقلابات عسكرية متتالية لم يسلم منها حتى أكبر الدول فاعلية في المنظمة، إضافة للنزاعات الإقليمية التي كانت سمة أفريقية بامتياز خلال أربعين عاما من عمر المنظمة. كما تطرق هذا البحث في الدراسة أيضا لأهداف ومبادئ الكيان القانوني الدولي الجديد ومدى اختلافها عن ما جاء في ميثاق منظمة الوحدة الأفريقية، وكذلك للجزاءات المفروضة على الأعضاء المنتهكين لقانونه التأسيسي، وبحثنا هنا أيضا الأجهزة العاملة في الاتحاد مقارنة بتلك التي عرفتها منظمة الوحدة الأفريقية، وهل تستطيع القارة السمراء تحمل النفقات الباهضة لهذا العدد الكبير من الأجهزة وأخيرا ما هي الجهة التي يمكن لها تقييم عمل هذا الكيان القانوني بعد مرور كل هذه السنوات على تأسيسه ومباشرته لنشاطاته المختلفة.
This research deals with the subject of an international regional organization had been established in the last years of the of the previous century in Africa. Such organization was then categorized as better and stronger than its previous organization. It is the African Union. In this research we will recognize the conditions which had accompanied its establishment, which some people categorize some of it as a reaction to the negativity of the African Unity in some main matters in the continent, those matters related to the failure of the development programs to achieve their purposes in spite of their financial and administrative volumes , or its difficulty in interfering to equally resolve internal and regional disputes as the continent had witnessed chronic consequent domestic wars and military over turns of which no state was away from even the biggest effective countries in the Organization. This research also discusses in this study the goals and principles of the new international legal entity and how they are different from the charter of the African Union Organization and the sanctions imposed on the violating members to its Charter. And we also have discussed the working systems in the Union in comparison with those systems the African Unity Organization had known, and whether the continent can assume the huge expenses for this big number of the Systems? Finally the assessment of the work of this legal entity after the lapse of more than seventeen years of its establishment and the commencement of its various activities.
