|a الثابت أن القانون الدولي المعاصر لا يعترف بالاحتلال الإسرائيلي لفلسطين إلا أنه ينظم هذه الواقعة ونتائجها، ومن بين هذه المسائل محل التنظيم هي حق الصحة للأطفال الفلسطينيين، ويعتبر هذا الحق من أهم الحقوق التي لا غنى عنها والتي يقوم عليها بقية الحقوق، ويعتبر الطفل من الفئات الضعيفة التي تحتاج إلى حماية معززة لأنهم أجيال المستقبل. وتعتبر هذه الدراسة محاولة جادة لدراسة حق الطفل الفلسطيني في الصحة طبقاً لأحكام القانون الدولي لحقوق الإنسان التي أفرزت الممارسات الدولية إمكانية انطباقه على حالات النزاع المسلح وحالات الاحتلال، ومع إبراز سلسلة القواعد الإنسانية بموجب القانون الإنساني سواء العرفية والاتفاقية التي تولي للأطفال حماية خاصة حفاظا على صحتهم وسلامهم مع مراعاة المركز القانوني لدولة فلسطين من ناحية القانون الدولي من حيث دراسة الموضوع. وانبثق عن هذه الدراسة العديد من النتائج التي تساهم في معرفة حق هذه الفئة – حق الطفل الفلسطيني في الصحة – بموجب القانون الدولي لحقوق الإنسان والقانون الدولي الإنساني وذلك لتمكين صاحب الحق في ممارسة سلطات صاحب الحق والتمتع به، وإمكانية إثارة مسؤولية قوات الاحتلال الإسرائيلي التي تتنصل من المسؤولية الدولية.

|b International law today does not recognize teh Israeli occupation of Palestine, but it regulates teh status and it's consequences, and among these issues of regulation are teh right for teh health of Palestinian children, and is considered teh most important rights dat are indispensable and support teh rest of teh children rights. Children are a vulnerable group dat requires enhanced protection because they are teh future pillars of society. This study is a intense attempt to examine teh Palestinian right to health of children in accordance wif teh provisions of international human rights law which produced teh international practices, teh possibility of it's application in situations of armed conflict and situations of occupation, wif teh focus on a series of humanitarian rules under humanitarian law, both customary and Convention, which offer children special protection in order to preserve there health and there peace taking into account teh legal status of teh State of Palestine in terms of international law related to teh study of teh subject. This study has risen many of teh results dat contribute to teh noledge of teh right of this category under international human rights law and international humanitarian law to enable teh Palestinian child to exercise his right authorities and teh possibility of holding responsible teh Israeli occupation forces, which disavows international laws.
