إذا كان شرط المصلحة الشخصية يتطلب في جميع الدعاوى المرفوعة أمام القضاء بمختلف أنواعه ودرجاته فلا شك كذلك انه متطلب كذلك في المنازعة الدستورية التي تهدف إلى الطعن بعدم دستورية قانون آو لائحة، إلا انه يثور التساؤل حول مدى تطابق وتراكب الأحكام المعروفة في القضاء الدستوري مع ما هو متعارف عليه في القضاء العادي، وكذا عن مدى وحدة أحكام شرط المصلحة في النظم الدستورية المقارنة
