تتناول هذه الدراسة موضوع العلاقة بين الفواعل غير الدولاتية وحقوق الإنسان، حيث تظهر وجود نظام قانوني دولي يسمح لها بممارسة نشاطاتها في الدفاع عن القضايا المتعلقة بحقوق الإنسان، ولكن هذا لا يعني وجود نوع واحد من الفواعل غايته حماية حقوق الإنسان، حيث أثبتت الدراسة أن هناك نوع آخر يسعى لتحقيق مكاسب ذاتية، مادية، تتنافى مع مبادئ حقوق الإنسان لابد من التصدي لها بفرض الرقابة على أنشطتها وتقييدها ومعاقبة المنتهكين. وفي سبيل حماية حقوق الإنسان، تنشط الفواعل غير الدولية بأشكال متعددة، إما في شكل منظمات غير حكومية داخلية أو دولية، وإما شكل مجتمع مدني عالمي أو داخلي أو في شكل أفراد، وتمارس مهام متعددة منها المشاركة في إعداد التقارير المراجعة الدورية الشاملة التي تقدم إلى مجلس حقوق الإنسان أو عن طريق عملية الضغط على المؤسسات الحكومية لتبني تشريعات تستهدف حماية الحقوق والحريات، وقد كان لهم جميعا دور كبير في تطوير منظومة حقوق الإنسان وإثرائها وفي ابتكار مفاهيم حقوقية جديدة كالمساواة التفاضلية والخصوصية الثقافية.
This study deals with the relationship between non-state actors and human rights. It shows the existence of an International legal system that allows them to exercise their activities in defending human rights issues. However, this does not mean that there is one type of non-state actors, which aims to protecting human rights. But there are others seek material gains, incompatible with human rights principles. They must be addressed by imposing controls on their activities, restricting them and punishing violators. In order to protect human rights, non-state actors are active in various forms, either in the form of internal or international non-governmental organizations, or in the form of a global or internal civil society, or in the form of or individuals. They are involved in the preparation of periodic review reports or through pressure on government institutions to adopt legislation for the protection of rights and freedoms. All of them have played a major role in developing and enriching the human rights system and in devising new human rights concepts such as differential equality and cultural diversity.
