المستخلص: تعد المرأة عصب المجتمع ، فهي التي ولدت ربت وسهرت ، وكانت ولازالت دوما سندا لأخيها الرجل ، هي التي يلحق بها دوما مال المجتمع فبصلاحها يصلح المجتمع؛ فهي المدرسة التي إن أعددتها أعددت شعبا طيب الأعراق ، ويكفي في الدلالة على مركز المرأة قوله صلى الله عليه وسلم : الجنة تحت أقدام الأمهات، وقولة أيضا: رفقا بالقوارير إن هذه المرأة قبل أن تصبح أما ، وهي أم ، بل وحتى بعيدا عن دور الأم ، إنسان في غاية الرقة والحساسية ، لذا سميت جنسا لطيفا ، تحتاج للإبقاء على هذه الصفات الربانية إلى حماية تكفل لها هذا الحنان المتجدد ، والعطاء الذي لا ينفذ ، فكان لزاما على المشرع ، أمام تنامي ظاهرة العنف ضد المرأة، إقرار نصوص جزائية عقابية تجرم هذه الظاهرة ، كيفما وحيثما كانت، وخاصة وأنها لا تمت لدين الدولة بصلة ، فهل أن هذه النصوص كافية لصيانة كرامة المرأة وتمكينها من أداء دورها في المجتمع على أكمل وجه . أم أنه ينبغي إعادة النظر فيها ؟ تلكم هي الإشكالية التي سنعالجها بهذه الورقة البحثية من خلال التطرق لصور تجريم العنف ضد المرأة ، العقوبات المقررة له ، أليات تحريك الدعوى العمومية والعقبات التي تواجه الضحية في ظل المنظومة القانونية القائمة .

The woman is considered to be the backbone of the society. She is the one who gave birth, raised and experienced sleeplessness. She was and still is the prop for her brother; the man. She is the one to whom the outcomes of society rest. That is because the society’s wellbeing is dependent upon hers. She is the school which if prepared by her, prepares a well-bread people. The following statement of the Prophet (Peace be upon him) is sufficient to indicate the standing of the woman: “Paradise lies under the feet of the mothers” and his statement: “Be kind with the vessels”. This woman, before she becomes a mother, and even long before assuming the role of the mother, is a person endowed with great tenderness and sensitivity, and as such she has been called the kind gender. To remain upon these divinely provided characteristics, she requires protection to ensure this continuously renewing tenderness and giving that does not deplete. It is therefore incumbent upon the legislator, in light of the growth of the phenomenon of violence against the woman, to adopt punitive penal provisions criminalizing this phenomenon, however and wherever it took place. That is particularly as this phenomenon has no connection to the religion of the country. However, are these legal provisions sufficient to preserve the dignity of the woman and enable her to undertake her role within the society fully? Or do they need to be reviewed? This represents the problem that we will be addressing in this research paper, by exploring the forms of criminalizing violence against the woman, the punishments which have been determined for it, the mechanisms of public prosecution and the obstacles which the victim faces under the existing legal system.
