إن راحة الحجاج وزوار بيت الله الحرام وسلامتهم من أولويات اعتنت به حكومة المملكة العربية السعودية، فقد اهتمت – مشكورة بالبعد عن كل ما يكدر عليهم صفو عبادتهم، حيث كلفت لهم حق التقاضي طيلة أيام السنة وعلي وجه الخصوص موسم الحج الذي سخرت فيه كل قدراتها وطاقاتها لراحة الحجاج وأمنهم، وما يكفل لهم حفظ حقوقهم، ومن ذلك (دوائر الحج القضائية) في الحرمين الشريفين وفي المشاعر المقدسة، وهو موضوع هذا البحث ونعني بها: المحاكم القضائية التي تنظر في القضايا التي تنشأ داخل حدود حرم مكة المكرمة، والمشاعر المقدسة، وتاريخ هذه الدوائر ممتد من زمن النبي صلى الله عليه وسلم إلى عصرنا الحاضرة، وأصلها ثابت بالسنة والأثر والقياس، وتتنوع اختصاصات هذه الدوائر إلى اختصاص: مكاني وزماني ونوعي، وتختص بجملة من المميزات، أهمها: تحقيق القاصد الشرعية، ولقد صدرت لائحة مختصة بدوائر الحج القضائية تسمى (لائحة أعمال دوائر الحجاج والمعتمرين، والمعمول به حاليا هو إنشاء هذه الدوائر في موسم الحج فقط.
The comfort and safety of pilgrims and the visitors of the holy places are priority for The Saudi government. The Saudi government takes care of these Holy places and tries its best to keep them away from all sorts of troubles or disturbances. Worshippers’ are ensured that they have the right to pursue their legal cases throughout the year and in particular during the season of Hajj. During this season, the government mobilizes all its capabilities and energies for the convenience and security of pilgrims. To guarantee preservation of pilgrims’ rights, the government has established (judicial pilgrimage circles) in The Holy Mosques and in the Holy Shrines. These (judicial pilgrimage circles) are the subject of this research .:These judicial courts deal with cases that arise within the boundaries of the Holy City of Makah, and within the Holy Shrines . The history of these circles extends from the time of the Prophet (peace and blessings of Allah be upon him) to our Present time, and their origin is documented in the Sunnah, impact and measurement. Specializations of these judicial circles vary to cover spatial, temporal and qualitative specializations, .They are characterized with certain features, the most important of which is their attempt to achieve the objectives of legitimacy. Alist of specialized judicial pilgrimage circles has been issued. This bylaw is called (The list of the work of the judicial circles of pilgrims and Umrah, These bylaws are in effect during the Hajj season only).
