المستخلص: إن نظام الوقف في الإسلام يمثل أحد مظاهر الرقي الحضاري للأمة الإسلامية، فالمتتبع للتاريخ الإسلامي يقف على مساهمة الأملاك الوقفية في تغطية بعض جوانب احتياجات الأمة في كافة نواحي الحياة، إلا أن النظرة الضيقة إلى الوقف على أنه مؤسسة دينية تعنى بشؤون المساجد والقائمين عليها فقط؛ أدى إلى تركيز الدراسات على البعد الديني، وانحسار دور الوقف في النواحي الدينية البحتة دون النظر إلى الأبعاد الاقتصادية والمالية للوقف، وعدم الأخذ بعين الاعتبار أن الأموال والممتلكات الوقفية جزء مهم من ثروة الدول، يمكن أن توظف بما يخفف العبء عن موازنة الدولة في تقديم الخدمات التعليمية والاجتماعية والصحية وحتى خدمات البنية التحتية.
وبالتالي فالعناية بالملك الوقفي لا تنحصر في التشجيع على الوقف فحسب، بل لابد من أن تتجه صوب إيجاد سلطة إدارية تسهر على الاستثمار فيه وكذا تنميته من أجل تأدية الغاية المرجوة منه.
وهو الأمر الذي دفع المشرع الجزائري الى مواكبة هذا التحول، ووضع سلسلة من النصوص القانونية، وذلك كله بغية ضمان السير الحسن لهذه الإدارة وفق توزيع مقنن لمهامها.


The Waqf (permanent endowment) system in Islam represents one of the manifestations of the cultural advancement of the Islamic Ummah. The followers of Islamic history understand the contribution of Waqf properties to cover some aspects of the needs of the nation among the total aspects of life. However, the narrow view about the Waqf that it is no more than a religious institution that deals with the affairs of mosques and those responsible for them. It has led to the focus of studies on the religious dimension, and the erosion of the role of the Waqf in purely religious aspects without regard to the economic and financial dimensions of the Waqf, and not taking into account that the funds and properties of the Waqf are an important part of the wealth of the states, that can be employed in a way that alleviates the burden on the state budget in providing educational, social, health and even infrastructure services.
Therefore, care for the waqf property is not limited to encouraging for the endowment only, but there must be an intention towards the creation of an administrative authority that oversees investing in it and develops it to fulfill its intended purpose.
This has prompted the Algerian legislature to keep pace with this change and to draw up a series of legal texts, all of which are aimed at ensuring the proper functioning of the administration in accordance with a regulated distribution of its functions.
