|d La garantie de parfait achèvement des travaux est une obligation légale qui a pour objet d’exécuter de réparations des malfaçons constatés par le maitre d’ouvrage conformément aux conditions prévus au contrat afin de les rendre conforme à l’état dans il devraient être à la réception des travaux. En droit Algérien cette garantie a été inspiré de la législation Française laquelle a été la première à créer la dite garantie et a élaborer un système juridique correspondant à son application. Néanmoins l’organisation de cette garantie par le législateur Algérien comporte des lacunes et des insuffisant ces notamment en ce qui concerne le champ et les modes de son application.

|a ضمان الإنهاء الكامل لانتقال الإنجاز يعد التزاما قانونيا موضوعه إصلاح كل خلل أشار إليه رب العمل، طبقا للشروط المنصوص عليها قانونا، وذلك بهدف إعادة العمل مطابقا للحالة التي كان عليها أو كان ينبغي أن يكون عليها عند التسلم. لقد استلهم المشرع الجزائري أحكام هذا الضمان من التشريع الفرنسي الذي كان سباقا في استحداث هذا الضمان، وفي وضع نظام قانوني نحكم له. غير أن تنظيم المشرع الجزائري لهذا الضمان يشوبه النقص والقصور، لاسيما من حيث نطاق تطبيق هذا الضمان وشروط تحققه وكيفية إعماله.

|b Works completion warranty is a legal obligation which aims to execute repairs of the defects recorded by the project owner in accordance with conditions stated in the contract to make theme consistent with the state that should be in during the project delivery. In the Algerian law, this warranty was inspired from the French legislation which was the first to create this warranty and to set a corresponding legal system for the application of this latter. However the organization of this system by the Algerian legislator contains deficiencies and gaps in particular in relation to thes scope and the modes of its application.
