يتناول هذا البحث قضية هامة من قضايا الفكر السياسي الإسلامي، وهي قضية الدولة المدنية، التي ثار الجدل حولها وما زال بين الفقهاء والمفكرين والسياسيين والقانونيين، وازدادت أهمية تناول هذا الموضوع ومناقشته في ظل الربيع العربي، الذي تشهده بعض الدول العربية، والذي أدى إلى تغييرات جذرية في بعض أنظمة الحكم السائدة، مكنت بعض الأحزاب الإسلامية من تقلد مفاتيح الحكم في بعض هذه الدول، وقد وجدت هذه الأنظمة الجديدة نفسها أمام تحديات كثيرة، أهمها طبيعة الدولة التي يمكن أن تكون مقبولة محليا ودوليا، ولا تتناقض كليا مع أحكام الشريعة الإسلامية، فطرحت الدولة المدنية كنظام سياسي يمكن أن يحقق نوعا من التوازنات بين مطالب العالم من جهة، وطموحات الشعوب المحررة من نير الظلم والاستبداد من جهة أخرى. فما هي الدولة المدنية؟، وما أركانها وخصائصها؟، وما موقف الإسلام منها؟، هذا ما سيبينه الباحث في هذا البحث الذي قسمه إلى أربعة مباحث، تناول في الأول: معنى الدولة وأهميتها، وفي الثاني: أنواع الدول وخصائصها، وفي الثالث: مفهوم الدولة المدنية ومبادئها وأهدافها، وفي الرابع: الدولة المدنية في التشريع الإسلامي وإشكالية العلاقة بينهما. وتوصل الباحث إلى نتائج متعددة ذكرها في نهاية بحثه، كما ذكر بعض التوصيات الهامة.
This research is examines one of the important issues of Islamic political thought: Issue of the civil state that controversy erupted on its nature, and still existed among scholars, intellectuals, politicians and jurists. The importance of investigating this subject or issue is remarkably increased in the light of the Arab Spring, which witnessed some of the Arab countries, and has led to collapse or radical changes of some dominant regimes. This spring has enabled, paved the way to, some Islamic parties to take over the power in these countries. The new regimes face great challenges. Most important of these is the nature of the state that should be in harmony of the international, local standards and fully abide by Islamic measures- without violating or breaching Islamic “Shari a Laws”. Thus, they offer the civil state as a political system that might secure a sort of compromise or balance between the international, World”, demands and the aspirations of liberated nations from the oppression and tyranny of old regimes. What is a civil state? What are the components, pillars, and characteristics of this state? What is the position of Islam from this state? For the researcher, these constitute the research questions that shall be addressed in this paper, which divided into four sections: The meaning and importance of the state presented in section one. Types and features of states discussed in section two. The civil state, in terms of the concepts, principles, and objectives, is examined and verified in section three. The fourth section is devoted for the civil state from Islamic law perspective, and the controversial relations between them. The researcher has come up with some results and important recommendations.
