المستخلص: The issue of ex-communication is similar to other questions governed by the principles of the Shari'ah. These principles are well defined and worthy of the utmost consideration in this issue. Therefore, the mainstream scholars worked hard to understand the relevant Shari'ah texts to find out the deeper aspects of the issue in addition to knowing the terms and conditions that should apply to the question of ex-communication. Accusing someone of atheism has been made conditional upon two factors: First: showing what makes a person atheist and what does not. Atheism is something determined by considerations provided on the basis of textual authority (naql) which does not admit personal opinions or preferences. It is one of the issues that particularly lies in the domain of the right of Allah and His Messenger. Second: showing that accusation of absolute atheism does not mean accusing a certain person of atheism. Conditions of accusation of atheism are three in relation to a certain person. First: he should be of age, mentally sound and has the ability to choose. Second: he should deliberately mean espousing pure atheism. Third: understanding the real nature of his view and its implications. The things that prevent from accusing some one of atheism are five: 1- making error. 2- ignorance. 3- helplessness. 4- coercion. 5- wrong interpretation.
