This paper explains the provisions for exercise of legal guardianship over marriage of a minor in Islamic law. The legal guardianship, according to the writer, is based on three components: the guardian, the legal minor, and the executive guardianship. The guardianship over a legal minor is meant for protecting his interests due to his being under age or his inability to conduct his affairs properly. The purpose of legal guardianship is to preserve, discipline, and educate legal minor to enable him to manage his personal affairs. The reasons of marrying off a free legal minor are four: being under age, insanity, imbecility, and femininity. The guardianship over a legal minor is of two types: special and general. Each type has its own conditions and provisions. The reasons of special guardianship over a free minor, male or female are: kinship, tutelage, and the legal rule (im mat). The reason of the general guardianship is: religion. The special guardianship has priority over the general one. |
