|b The financial assistance provided by credit institutions is primordial for developing business. Indeed, in a context of globalization and economic liberalization, internal funding does no longer provide enough resources to allow competitiveness and future growth on the market. Credit granting process is based on a set of rules and conditions and typically involves risk-taking for the credit granting institution. This risk increases even more when the company requesting financial support is troubled within the meaning of law: suspect period, bankruptcy etc… In these cases, the bank is in a delicate position: The credit contract could be suspended or cancelled. Worse still, the bank could incur civil liability if credit granting or breaking the credit contract is qualified as abusive by the judge. Furthermore, the issue of bank claims arises when the troubled company is filed for bankruptcy.
