المستخلص: There is no doubt that any researcher in the Shariah sciences necessarily needs to know the Arabic language and its rules, especially grammar. It is a prerequisite for understanding the legal texts and has the greatest impact on utilizing its rules. Therefore, scholars have taken an interest in linking the jurisprudence matters and the grammatical rules that were adopted in order to reach the provisions of those matters. This is what we are discussing in this topic: “Documentation of jurisprudence branches according to grammatical principles.” It has been divided into three chapters. The first chapter is an introduction about the explanation of the relationship between grammar and jurisprudence and the confirmation of the close link that brings the two sciences together so that the jurist cannot dispense with the grammar in any way. The second chapter is devoted to introducing the art of jurisprudence documentation on grammatical principles and reviewing its historical stages and the important efforts of scholars and their writings in this art.
In the third and final chapter, the emphasis was placed on the effects of grammar dispute on the dispute of Fuqaha' by mentioning practical examples of jurisprudence matters in which the opinions of the scholars of the shari'ah differ according to the differences of the scholars of grammars.

إن مما لا شك فيه أن أي باحث في العلوم الشرعية هو محتاج بالضرورة إلى معرفة علوم اللغة العربية وقواعدها، خاصة علم النحو إذ هو شرط أساسي في فهم النصوص الشرعية، وله أكبر الأثر في استفادة الأحكام منها، ولهذا اعتنى العلماء بالربط بين المسائل الفقهية والقواعد النحوية التي اعتمدت للوصول إلى أحكام تلك المسائل، وهو ما نبحثه في هذا الموضوع: (تخريج الفروع الفقهية على الأصول النحوية) وقد تم تقسيمه إلى ثلاثة مطالب، أما المطلب الأول فهو عبارة عن مقدمة في بيان العلاقة بين النحو والفقه، وتأكيد الصلة الوثيقة التي تجمع العلمين بحيث لا يمكن للفقيه أن يستغنى عن النحو باي حال من الأحوال، أما المطلب الثاني فقد خصص للتعريف بفن التخريج الفقهي على الأصول النحوية واستعراض مراحله التاريخية وأهم جهود العلماء ومؤلفاتهم في هذا الفن، وفي المطلب الثالث والأخير تم التركيز على آثار الخلاف النحوي على اختلاف الفقهاء وذلك بذكر أمثلة عملية لمسائل فقهية تعددت فيها آراء علماء الشرع تبعا لاختلاف أقوال النحويين فيها.

Certes, tout chercheur dans le domaine des sciences islamiques a nécessairement besoin de connaitre les règles et les sciences de la langue arabe, surtout la grammaire : une condition très essentielle pour comprendre les textes religieux, cette dernière a un effet important d’en retenir les jurisprudences. Une raison pour laquelle plusieurs savants se sont intéressés en reliant entre les questions de jurisprudence et les règles grammaticales qu’ont adoptées les savants pour aboutir aux jurisprudences de ces questions: ce dont nous faisons quête dans ce sujet: (Théorie de l’Extraction des Jurisprudences à Partir des Règles Grammaticales), que nous répartissons à trois phases, dont la première est présentée sous forme d’une introduction à définir la relation entre la grammaire et la jurisprudence, et le lien dur qui relie les deux sciences où l’expert en jurisprudence ne peut en aucun cas ignorer son besoin à la grammaire. Or, dans la deuxième phase, est consacrée à la définition de l’art de l’extraction des jurisprudences des bases grammaticales, et d’exposer ses étapes historiques et les importants efforts des savants et leurs œuvres dans cet art. Enfin, dans la troisième et la dernière phase, nous nous basons sur les effets de l’hétérogénéité des avis des experts en jurisprudence ; en citant des exemples opérationnels sur des questions jurisprudentielles où nombreuses étaient les opinions des savants de l’Islam selon la différence et l’hétérogénéité des citations des grammairiens dans ces propos.
