المستخلص: Freedom of the press is one of the fundamental foundations of a democratic society and one of the prerequisites for its progress and development. The European Court of Human Rights considered the freedom to issue newspapers as one of its main pillars. Algeria recently passed a media law 12-05, which approved fundamental changes in the field of media, most notably opening the audiovisual area, in the field of print journalism. The new law made the issuance of newspapers a licensing system by obtaining accreditation from the controlling authority.
The new law also created the power to control the print media and abolished the Supreme Media Council. Reducing press crimes and restricting them to offenses and misdemeanors is one of the most important provisions of the new law, in contrast to the 1990 law, which was described as penal law.
This study seeks to analyze the freedom to issue the press (periodicals) in the Media Acts (12-05 and 90-07) and to clarify the differences between them.

La liberté de presse constitue l’un des fondements essentiels d’une société démocratique, l’une des conditions primordiales de son progrès et de l’épanouissement de chacun, la Cour européenne des droits de l’homme considère la liberté de l’édition des publications comme l’une des pierres angulaires de la liberté de la presse. L’Algérie a récemment publié une loi de l’information 12-05, cette nouvelle loi a approuvé des changements fondamentaux dans le domaine médiatique, La loi 12-05 a établi un nouvel organe appelé l’autorité de régulation de la presse écrite et elle a abrogé le conseil supérieur de l’information.
Cet article analyse la liberté de l’édition des publications périodiques dans les codes de l’information algériens (12- 05, 90- 07), l’article explique les différences entre les deux codes.


تشكل حرية الصحافة أحد الأسس الجوهرية للمجتمع الديمقراطي، وأحد الشروط الأساسية لتقدمه وتطويره، واعتبرت المحكمة الأوربية لحقوق الإنسان حرية إصدار الصحف أحد ركائزها الأساسية، وقد أصدرت الجزائر مؤخرا قانونا للإعلام 12-05، أقر تغييرات جوهرية في مجال الإعلام، من أبرزها فتح المجال السمعي البصري، وفي مجال الصحافة المكتوبة أخضع القانون الجديد إصدار الصحف لنظام الترخيص من خلال الحصول على الاعتماد من سلطة الضبط.
كما استحدث القانون الجديد سلطة ضبط الصحافة المكتوبة وألغى المجلس الأعلى للإعلام، ويعتبر تقليص الجرائم الصحفية وحصرها في المخالفات والجنح من أهم ما جاء به القانون الجديد على عكس قانون 1990 الذي تم وصفه بقانون للعقوبات.
وتسعى هذه الدراسة إلى تحليل حرية إصدار الصحافة (النشريات الدورية) في قانوني الإعلام (12-05 و90-07)، وتوضح الفروق بينهما.
