المستخلص: نبعث فكرة البحث من اتصاله بأثر المصلحة والمفسدة على الاستدلال الفقهي، عند التعارض الظاهري الذي ينشأ في ذهن الفقيه أو المجتهد، وكان لذلك الأثر دور بارز في ظهور فقه الموازنات إلى الوجود، وقد عالج البحث بشكل أساس إشكالية تردد المصلحة والمفسدة بين العقل والنقل، ومدى صلاحية استخدامها في موازنة الأدلة المتعارضة ظاهريا. واشتمل البحث على مقدمة وثلاثة مباحث، تناولت، على التوالي، مفهوم التعارض ومجالاته والمصلحة والمفسدة في فكر الآمدي، ثم أخيرا أثر المصلحة والمفسدة في دفع التعارض بين الأدلة الشرعية في الفكر الأصولي للآمدي. وتوصل البحث إلى أن الاعتماد على المصلحة والمفسدة في دفع التعارض يستدعي توافر ضوابط شرعية يجب مراعاتها حال العمل على إزالة التعارض، وأن الآمدي رحمه الله تعالى قد أرسى هذه الضوابط وهو يؤطر لكيفية الموازنة بين الأدلة، وهو بذلك قد أضاف مرجحا إلى مجموعة المرجحات المستقرة أصوليا. وقد أوصى البحث باتخاذ رؤية الآمدي، رحمه الله تعالى، في الاستناد إلى المصلحة في الترجيح بين الأدلة أنموذجا في الموازنة عند الاستدلال والاستنباط.

The idea of the research has emerged from its connection to the impact of the interest and corruption on the jurisprudential reasoning in the apparent contradiction that arises in the mind of the jurisprudent or the diligent. Therefore, this effect had a prominent role in the emergence of the jurisprudence of Budgets to exist. The researches mainly dealt with the basis of the repeated problematic of interest and corruption between mind and transcription, and the appropriateness of their used in balancing the conflicting evidence apparently. The research included an introduction and three topics, which dealt, respectively, with the concept of conflict and its areas, interest and corruption in the thought of Al-Amadi, and finally the impact of interest and corruption on avoiding the conflict between the legal evidences in the fundamentalist thought of Al-Amadi. The research found that relying on the interest and the corruption in avoiding the conflict requires the availability of the legitimate controls that must be observed in case of working to remove the conflict. Al-Amadi, may Allah have mercy on him, established these controls while he was framing how to balance the evidences, which he added likely to the set of stable fixed assumptions. The research recommended the need to take the view of Al-Amadi, may Allah have mercy on him, in relying on the interest in the balancing between the evidences as a model in the budget at the reasoning and deduction.
