|a حفاظا على سير المرافق العامة بانتظام واطراد منحت التشريعات المنظمة للعقود الإدارية في مختلف الدول الإدارة الحق في فرض جزاءات متنوعة على المتعاقد المقصر معها، ومن بينها ما يسمى بالجزاءات الضاغطة أو اجراءات الضغط المؤقتة والتي تختلف باختلاف نوع العقد الإداري، تقوم بها الإدارة دون الحاجة الى النص عليها في العقد واللجوء الى القضاء استنادا الى سلطتها وامتيازها في التنفيذ المباشر.\n في هذا البحث عالجنا النظام القانوني للجزاءات الضاغطة في دولة الإمارات العربية المتحدة استنادا الى ما جاء في نظام عقود الإدارة الاتحادي مع مقارنته بما جاء به قانون المناقصات والمزايدات المصري، من خلال التركيز على عقدي الأشغال العامة والتوريد. وتبين لنا أن هذه الجزاءات تتميز بانها اجراءات مؤقتة ليس الهدف منها إنهاء العقد بل للضغط على المتعاقد للوفاء بالتزاماته، تقوم بها الإدارة ضمن شروط وضوابط معينة، ورغم أنها كذلك الا أنه يترتب عنها مجموعة من الاثار التي ترهق المتعاقد ماديا ومعنويا، وتتمثل صور هذه الجزاءات في سحب العمل من المقاول في عقود الأشغال العامة والشراء على حساب المورد في عقود التوريد.

|f In order to maintain the constant functioning of public facilities on a regular basis, the legislation regulating administrative contracts in various States gave the administration the right to impose various sanctions on the defaulting contractor including the so-called pressurizing sanctions or temporary pressure measures, which vary according to the type of administrative contract, carried out by the administration without the need to provide precept for them in the contract and to resort to the judiciary on the basis of its authority and prerogatives to direct execution.\nIn this research, we dealt with the legal system of pressurizing sanctions in the United Arab Emirates based on what is stated in the system of contracts of the federal administration, comparing it with the provisions of the Egyptian law of tenders and auctions, by focusing on the contracts of public works and procurement. We find that these sanctions are characterized as temporary measures not intended to terminate the contract but to pressurize the contractor to meet his commitments, carried out by the administration under certain conditions and rules. Although it is like that, but it involves a number of effects that burden the contractor materially and morally. These sanctions are manifested in the form of withdrawal of work from the contractor in the contracts of public works and purchase at supplier's expense in the contracts of supply.\nThis abstract translated by Dar AlMandumah Inc. 2018
