|f Legal translation is a technical process involving the language of specialisation, based on two legal languages to express two different legal systems. This poses a real problem, which is the transfer of terms that belong to the field of law, especially with regard to words belonging to the Islamic Shari'a field, because of their moral connotations. The Algerian family law, especially the chapter of inheritance, is characterized by many terms that are linked to the Islamic legislation. It poses a real difficulty in terms of the concepts it carries and requires the translator to have the necessary translation skills. In order to overcome the most important problems that hinder the translation process in the field of legal terms belonging to Islamic legislation, it was necessary, By following the analytical approach of these terms, relying on the approach of terminology as a translation method to overcome the difficulties faced by the translator in this field.\nThis abstract translated by Dar AlMandumah Inc. 2018

|a تعد الترجمة القانونية عملية ذات طابع تقني تنطوي علي لغة الاختصاص، وتقوم علي لغتين قانونيتين للتعبير عن نظامين قانونيين مختلفين، مما يطرح إشكالية حقيقية تتمثل في نقل المصطلحات التابعة لمجال القانون، وبالخصوص فيما يتعلق بالألفاظ المنتمية للمجال الشرعي الإسلامي لما تحمله من دلالات معنوية. ويتميز قانون الأسرة الجزائري وخاصة باب الميراث يحمله مصطلحات عديدة تابعة للتشريع الإسلامي وهي تطرح صعوبة حقيقية علي مستوى المفاهيم التي تحملها، وتستوجب من المترجم التحلي بالكفاءات الترجمية اللازمة. وللتغلب علي أهم الإشكاليات التي تعرقل المسار الترجمي في مجال المصطلحات القانونية المنتمية للتشريع الإسلامي، كان لزاما، بإتباع المنهج التحليلي لهذه المصطلحات، الاعتماد علي المقاربة بين المصطلحات كطريقة ترجمية لتذليل الصعوبات التي تواجه المترجم في هذا المجال.

|b La traduction juridique est une activité technique qui fait intervenir une langue spécialisée, et qui exprime des réalités correspondant à des systèmes juridiques distincts, ce qui pose une problématique réelle au niveau de la terminologie, précisément les termes à contenance culturelle et religieuse, et ce par le fait de porter des notions morales propres à un domaine de spécialité. Le code de la famille Algérien, précisément le chapitre des successions, se caractérise par sa terminologie correspondant à la doctrine islamique, en présentant ainsi une difficulté au niveau des définitions, ce qui impose au traducteur d’avoir les compétences traductologiques requises. Au vu des nombreuses difficultés rencontrées par le traducteur en terminologie juridique, la méthode terminologique comparée s’avère nécessaire dans la résolution des problèmes auxquels fait face le traducteur dans ce domaine.
