المستخلص: Prévu en droit international de brevet, et dans les législations nationales, le régime de licence obligatoire constitue l’une des rares limites du monopole du titulaire du brevet. Toutefois le recours à ce système reste subordonné à des conditions diverses. Le présent article, essaye d’interpréter l’application du régime de licences obligatoires pour motif d’intérêt public prévu par la législation algérienne, et ce à la lumière du droit comparé et du droit international des brevets dans le but de mesurer l’efficacité de ce régime à atteindre ses objectifs.

Provided in international patent law, and in national legislation, the compulsory licensing system is one of the few limitations of the patent owner's monopoly. Indeed, if the general rule is that this holder is free to personally exploit the protected invention or to authorize its exploitation to a third party, this system allows to derogate from this rule by granting this to a third party without the consent of that holder. However, recourse to this system remains subject to specific conditions which are mainly related to the objective of the public interest. This article attempts to interpret the application of the system of compulsory licenses provided for by Algerian law, in the light of comparative law and international patent law, and in order to measure the effectiveness of this system to achieve its objectives.
