المستخلص: Jurisprudence adaptation is essential for Islamic Sharia law in general and for its policies in particular. It guarantees sustainability and relatedness of Sharia till the day of resurrection and touches upon the need for it in Sharia policies. Jurisprudence adaptation is a science that is numerous in contemporary overlapping applications. It is also a complicated field in which feet slipped and conceptions went astray. Thus, it was incumbent to promote its mechanisms and implement its steps so that diligence could be sound and decision could be right. This research paper deals wif jurisprudence adaptation mechanism of Sharia law and the three steps of it which include conceptualizing the incident, determining the origin similar to it and applying the conceptualized incident on it. Afterwards, the research shows the role of diligence evidences in adapting Sharia law policies to make it applicable on contemporary incidents ease understanding and clarify rules. The study concluded after studying a number of calamities according to the mechanism of adapting the jurisprudence to: permitting automated imaging in principle, permitting the contract of supply, and permissible purification of treated wastewater. The researcher also recommended dealing wif the topics of Shariah policy in more research and study, especially contemporary issues, according to the mechanism of adapting the jurisprudence, and steps, and controls.

إن التكييف الفقهي ضروري للشريعة الإسلامية عامة ولسياستها خاصة، فهو الذي يكفل خلودها، وصلاحيتها للتطبيق إلى يوم القيامة، وتمس الحاجة إليه في السياسة الشرعية، فهو علم تكثر نوازله، وتتشابك حوادثه، وهو معترك صعب، زلت فيه الأقدام، وضلت به الأفهام، فكان لابد من إعمال آلياته، وتطبيق خطواته؛ ليكون الاجتهاد قويما، والحكم سديدًا. ويتناول هذا البحث آلية التكييف الفقهي للسياسة الشرعية وخطواته الثلاث، وهي: تصور النازلة، وتحرير الأصل المشابه لها، ثم تطبيقه عليها، ثم يبين دور الأدلة الاجتهادية في تكييف أحكام السياسة الشرعية، ثم التطبيق على ذلك بنوازل معاصرة، تيسر الفهم، وتجلي القواعد. وخلص البحث بعد دراسة جملة من النوازل وفق آلية التكييف الفقهي إلى: إباحة التصوير الآلي من حيث المبدأ، وإباحة عقد التوريد، وجواز التطهر بالمياه العادمة المعالجة نهائيا. كما أوصى الباحث بتناول موضوعات السياسة الشرعية بمزيد من البحث والدراسة، وخاصة المسائل المعاصرة منها، وفق آلية التكييف الفقهي، وخطواته، وضوابط.
