المستخلص: The institution that enjoys its dominating position in the market may resort to arbitrary practices that harm its customers on the one hand and in the market and competition on the other. These practices aim to exclude competitors and promote the position of dominance. These practices are manifested in the unjustified refusal to deal, especially in the case of non-compliance with the conditions of the monopoly organisation, and the application of secondary contractual terms that have nothing to do with the nature of the contract, in addition to the associated sale or the concomitant sale through which the dominant institution seeks to exploit its control over the desired product in the market, by imposing the purchase of another product that has nothing to do with the place of the contract and the buyer has no need for it.

L'entreprise qui a sa position dominante sur le marché peut recourir à des pratiques abusives qui nuisent à ses clients, Et le marché et la concurrence d'autre part, où ces pratiques visent à éliminer les concurrents et renforcer la situation de domination. Ces pratiques se traduisent par le refus de contracter sans justification, notamment en cas de non-respect des conditions de l'entreprise monopolistique, et l'application des clauses contractuelles secondaires n'a rien à voir avec la nature du contrat. En plus de la vente liée, dans laquelle l'entreprise dominante cherche à exploiter son contrôle sur le produit requis sur le marché en imposant l'achat d'un autre produit qui n'a rien à voir avec le contrat et n'entre pas dans les besoin de l'acheteur.

قد تلجأ المؤسسة التي تتمتع بمركزها المهين في السوق إلى ممارسات تعسفية تضر بالمتعاملين معها من جهة، وبالسوق والمنافسة من جهة أخرى حيث تهدف هذه الممارسات إلى إقصاء المنافسين وتعزيز وضعية الهيمنة. وتتجلى هذه الممارسات في رفض التعامل من دون مبرر، خاصة في حالة عدم الانصياع لشروط المؤسسة المحتكرة، وتطبيق شروط تعاقدية ثانوية لا علاقة لها بطبيعة العقد إضافة إلى البيع المرتبط أو البيع المتلازم والذي تسعى المؤسسة المهيمنة من خلاله إلى استغلال سيطرتها على المنتج المطلوب في السوق، بفرضها شراء منتوج آخر لا علاقة بمحل العقد ولا حاجة للمشتري به.
