|f This research presents a modern Fiqhi study on the topic of the “disorder” in the body of the “hadith” and its impact on Islamic jurisprudence. We also defined the "hadith mudtarib" and its types, in addition to explaining the disorder in the body. The study then presented the provisions (fiqhi) in which the disturbance of the body of the hadeeth were found in the chapters of "taharah" and "Salah" to serve as an example for that.\nAmong these provisions in the topic of "Taharah" are the provision of purification of water if there is “Najasah” in it and none of its descriptions has changed, the issue of cleaning semen, the ruling on purifying skin after tanning, and the renewal of water to wipe the head during ablution' and the renewal of the second touch (to dust) while performing "tayammum".\nThe disturbance in the body of "Hadith" is also evident in a number of provisions of "Salah" which include answering the "Muazzin" (while he calls for prayers), the limiting the "Awrah" (parts of body which must be kept hidden) of a man, saying "basmalah" loudly in the loud prayers (salah), and how to go down to prostration in prayer, and prostration of forgetfulness (Sajdat us Sahaw) after completing the prayer by those who forget to complete it.\nThe researcher reached many findings, the most important of which include that there is no disorder in the body of “Hadith” in the provisions that were studied. The view that there is a disorder in some “ahaadeeth” is based on the equal strength of the narrations, but what is clear is that some of these narrations are not equal, some of them are weak and some are of varying power. |a يقدم هذا البحث دراسة فقهية حديثية حول موضوع القول باضطراب متن الحديث وأثره في الفقه الإسلامي، حيث تم التعريف بالحديث المضطرب وأنواعه، وبيان أقسام الاضطراب الواقع في المتن، ثم تم عرض المسائل التي ظهر فيها القول باضطراب متن الحديث في مبحثي الطهارة والصلاة لتكون نموذجا لذلك. \nوكان من هذه المسائل في مبحث الطهارة، مسألة طهارة الماء إذا وقعت فيه نجاسة ولم تغير أحد أوصافه، ومسألة طهارة المني، وحكم طهارة الجلد بعد دباغته، وتجديد الماء لمسح الرأس في الوضوء وتجديد الضربة الثانية في التيمم. \n كما ظهر القول باضطراب متن الحديث في عدد من مسائل الصلاة منها مسألة إجابة المؤذن، وحد عورة الرجل، والجهر بالبسملة في الصلاة الجهرية، وكيفية النزول إلى السجود في الصلاة، وسجود السهو بعد إتمام الصلاة لمن نسي إتمامها. \nوقد توصل الباحث إلى عدة نتائج من أهمها، أنه لا وجود لاضطراب متن الحديث في المسائل التي تم بحثها، حيث إن القول بالاضطراب في بعض الأحاديث كان مبناه تساوي الروايات في القوة، إلا أن الذي تبين هو عدم تساوي بعض هذه الروايات، فمنها ما هو ضعيف، ومنها ما هو متفاوت في القوة، وأما الروايات التي ظهر فيها التساوي فقد أمكن الجمع بينها والعمل بها جميعا.
