المستخلص: إن أي مجتمع إنساني، مهما كانت طبيعة نظام الحكم فيه، وأسلوب إدارته لمؤسساته، أو وسيلة التعبير عن شكل الحكم فيه، لا يمكن أن يعيش بمعزل عن صيانة أمنه الذي يضمن له البقاء والديمومة تجاه الأخطار والتهديدات التي قد تواجهه، سواء أكانت من جهة علاقته بالمحكومين من داخل المجتمع ذاته، أو من خلال علاقته بغيره من المجتمعات، ولهذا تحتل قضية الأمن مكان الصدارة والاهتمام من بين القضايا التي تسعى تلك المجتمعات لتأمينها، وبمختلف توجهاتها السياسية والاقتصادية والاجتماعية. ومسألة الأمن والدفاع بالنسبة للمجتمع الكوردي، شأنه في ذلك شان المجتمعات الإنسانية الأخرى، تمثل المكانة ذاتها، إن لم تكن أكثر، ذلك لان الأمة الكوردية كانت، ولا ترال عرضة لخطر التهديد بالفناء، وضحية لسياسات استعمارية خاطئة، وهدفا مركزيا تسعى المطامع الأجنبية للنيل منها، تحت ذرائع شتى يعود بعصها إلى ادعاءات تاريخية باطلة، أو لأسباب اقتصادية دافعها الأساسي الطمع في ثرواتها وخيراتها، أو لعوامل جغرافية نظرا لموقعها الاستراتيجي في المنطقة، أو ربما لا لأحد من هذه الأسباب بل لأنهم خلقوا كوردا. وفي ضوء ذلك، ونتيجة للموقع القانوي والدستوري الذي يتمتع به إقليم كوردستان العراق كونه إقليما ضمن الدولة العراقية الاتحادية، يتمتع بسلطات وصلاحيات واسعة تؤهله لوضع استراتيجية شاملة لمسألة الأمن والدفاع، الأمر الذي مس الحاجة لدراسة الوضع القانوني لأجهزة الأمن والدفاع في إقليم كوردستان. وتضطلع بالمهمة الأمنية في الإقليم أربعة أجهزة أمنية هي: مجلس الأمن في إقليم كوردستان وحرس الإقليم، وجهاز شرطة الإقليم، وجهاز أمن الإقليم. ويعتمد الأساس الدستوري لتشكيل أجهزة الأمن والدفاع في إقليم كوردستان على عدة مواد دستورية وردت في دستور جمهورية العراق لسنة 2005، إلى جانب القوانين التي تنظم عمل هذه الأجهزة.

In light of this, and as a result of the legal and constitutional for the site, which has Iraqi Kurdistan as a territory within a federal Iraqi state, enjoys the powers and broad powers qualify him to develop a comprehensive strategy to its national security of self-based Bugbane, which touched the need to study the legal status of the organs of security and defense in the Kurdistan Region. And assume the security mission in the region of four security agencies is: the Security Council in the Kurdistan Region and the Regional Guard, a provincial police, a security of the region. And it supports the constitutional basis for the formation of security and defense in the Kurdistan Region devices on several constitutional articles contained in the Constitution of the Republic of Iraq for the year 2005, as well as the laws that govern the operation of these devices.
