المستخلص: This research discusses the contradiction of the school of thought among the Muslim scholars of the Maaliki School and the reformist approach in this regard so that it shows its bright face from being not a negative process or an anomaly from the correct method. The approach used in this research is descriptive. Just as people are divided into ordinary and Mujtahids (the one who can exercise Ijtihad), Ijtihad (The Extraction of Islamic Law) has also some stages. Therefore, the Mulim scholars of the jurisprudential school don’t have the same status. Some of them are Mujtahid Mukhrij (The Extrapolative Mujtahid). Some of them have a lower status than them. Even this status reaches the stage of metaphorical jurisprudence which is a mastery of a section of the jurisprudence. It is therefore natural that there are many different points of views and opinions in this vast jurisprudence school which most of the people of jurisprudence school consider a rare or rejected thing. However, there are some opinions followed by some scholars to whom there is nothing for the passion. It should have a scientific value. This research will try to clarify the term Mazhab (school of thought) as per the Maaliki School. It will also try to explain the reasons for the contradiction of the Mazhab (school of thought). The research found that the term “Mazhab (school of thought)” as a subject is a school of teaching, Fatwa and judgment. It also found that the most prominent reasons that made the Muslim scholars oppose the Mazhab (school of thought) are strong evidence, interest, taking care of ease, trend, habit and the influence of other Mazhabs (schools of thought). Based on the above, the opposition of the Mazhab (school of thought) is the result of the intellectual development of the scholars of the Maliki school and their departure from the power of one view, despite the deniability of the majority of those who came after them.

يتناول هذا البحث مخالفة المذهب عند فقهاء المالكية، والمنهج التجديدي في ذلك، بحيث يعرض وجهها المضيء من كونها ليست عملية سلبية، أو شذوذا عن المنهج الصحيح، والمنهج المتبع في هذا البحث هو المنهج الوصفي، وكما ينقسم الناس إلى عوام ومجتهدين، فإن الاجتهاد مراتب، من هنا فإن فقهاء المذهب ليسوا كلهم على درجة واحدة، فمنهم المجتهد المخرج، ومنهم من دون ذلك، إلى أن يصل الأمر لمرحلة الفقه المجازي الذي هو إتقان مختصر من مختصرات المذهب، وهكذا فإنه من الطبيعي أن تكون في هذا المذهب العريض وجهات نظر مختلفة، وآراء يحسبها أكثر أهل المذهب شاذة، أو مردودة، لكنها تبقى آراء انتهجها علماء ليس للهوى نصيب في اختيارهم أو ترجيحهم، فينبغي أن تكون لها قيمتها العلمية، لذلك فإن هذا البحث سيتعرض لتوضيح مصطلح المذهب عند المالكية، كما سيتعرض لبيان أسباب مخالفة المذهب، وقد توصل البحث إلى أن مصطلح المذهب باعتبار هذا الموضوع: مذهب تدريس، وإفتاء، وقضاء. كما توصل إلى أن أبرز تلك الأسباب التي جعلت فقهاء المذهب يخالفونه هي: الدليل القوي، والمصلحة ومراعاة اليسر، والعرف أو العادة، وتأثير المذاهب الأخرى. وبناء على ما سبق فإن مخالفة المذهب ناتجة عن التطور الفكري لعلماء المذهب المالكي، وخروجهم عن سطوة القول الواحد، رغم نكير جمع: من المتأخرين على هم.
