المستخلص: The composition of the Supreme Council of Magistracy is of great importance in view of the tasks entrusted to it as guarantor of the judge's independence and the independence of the judiciary, which ensures the professional conduct of the judge from his appointment to the end of his functional relation. It is this composition which guarantees the discipline in case of error, the question of the composition of the Superior Council of Magistracy raises many criticisms at the level of the countries of the world. But more than that, the composition of the Superior Council of Magistracy is at the heart of the debate every time the reform of the judicial system has been addressed. I have therefore tried through this study to highlight the composition of the Superior Council of Magistracy and its consecration of the independence of the judge

تكتسي تشكيلة المجلس الأعلى للقضاء أهمية بالغة بالنظر للمهام المنوطة بها باعتبارها الضامنة لاستقلالية القاضي واستقلال القضاء برمته فهي التي تسهر على تسيير المسار المهني للقاضي ابتداء من تعيينه الى غاية انتهاء علاقته الوظيفية بالإضافة الى أنها الضامنة في حالة تأديبه إن أخطأ. وتبقى مسألة تشكيلة المجلس الأعلى للقضاء تثير العديد من الانتقادات على مستوى دول العالم بل الأكثر من ذلك، فإنه متى أثيرت مسألة إصلاح المنظومة القضائية إلا وكان تشكيلة المجلس الأعلى للقضاء في صلب النقاش. لذلك حاولت من خلال هذه الدراسة تسليط الضوء على تشكيلة المجلس الأعلى للقضاء ومدى تكريسها لاستقلالية القاضي.

La constitution du conseil supérieur de la magistrature jouit d’une importance primordiale ou les roles qu’elle joue. C’est elle qui assure l’indépendance du magistrat ainsi que celle de la magistrature dans sa globalité. Elle veille à la gestion du parcours professionelle du magistrat depuis son instalation jusqu’à la cession de la relation du travail de plus, c’est elle qui se préoccupe de le discipliner en cas d’erreurs. La constitution du conseil supérieur de la magistrature demeure la problématique qui animent les débats à l’échelle mondiale. Ajoutons que là ou on évoque la question de la réforme de l’oganisation de la magistrature on voit que c’est la constitution de cette derniere qui est le vif du sujet. C’est pour cette raison que nous essayons, à travers cette étude de mettre l’accent sur la constitution du conseil supérieur de la magistrature et sa mise en oeuvre de l’indépendance du magistrat?
