المستخلص: في سياق السياسات التي تنتهجها مختلف دول العالم لجذب الاستثمار الأجنبي، تبرز أهمية وضع أسس كفيلة بتحقيق التوازن الاقتصادي لعقود الاستثمار الدولية كمطلب رئيسي لمخاطرة المستثمرين الأجانب برؤوس أموالهم، ويعد إخضاع عقود الاستثمار الدولية لمبدأ سلطان الإرادة أهم هذه الأسس، غير أنه وفي ظل تنامي المخاطر غير التجارية التي تهدد استقرار العقد وتوازنه على النحو الذي تقرره إرادة الأطراف المتعاقدة، يبرز التزام الدولة المضيفة للاستثمار بعدم التعرض للعقد بإرادتها المنفردة كأساس ثان مدعم لمبدأ سلطان الإرادة من أجل تحقيق التوازن الاقتصادي المنشود.

Dans le contexte des politiques adoptées par divers pays du monde pour attirer les investissements étrangers, est soulignée l’importance de jeter les bases de la réalisation de l'équilibre économique des contrats d'investissement internationaux comme exigence majeure pour les investisseurs étrangers risquant avec leur capital. La subordination des contrats d'investissement internationaux au principe de la volonté est la base la plus importante. Cependant, compte tenu des risques non commerciaux croissants qui menacent la stabilité et l'équilibre du contrat, déterminés par la volonté des parties contractantes ; il ressort l'engagement de l'État hôte à l'investissement de ne pas soumettre le contrat à sa volonté unilatérale comme une deuxième base soutenant le principe de volonté pour atteindre l'équilibre économique souhait.

In the context of the policies adopted by different countries of the world to attract foreign investment, the importance of laying sufficient foundations, by accomplishing economic balance of international investment contracts, is highlighted as a key requirement for foreign investors to risk their capital. Subjecting international investment contracts to the authority of the will is regarded to be the most important of these. However, in light of the growing non-commercial risks to the stability and balance of the contract, as determined by the will of the contracting parties, the commitment of the state hosting the investment is highlighted by not being exposed to the contract via its unilateral will as a second supportive pillar for the principle of the authority of the will, in order to achieve the desired economic balance.
