إن الحديث عن حقوق الإنسان وحرياته حديث الأمس واليوم والغد، وهو حديث الفطرة تتلقاه القلوب والأرواح ببهجة وسرور، لأن النفس الإنسانية تواقة إلى الحرية والعيش الرغيد، ولا معنى للحياة بدون الحرية والكرامة. وقد وضع الرسول الكريم (صلى الله عليه وسلم) القواعد الأساسية لحقوق الإنسان وحرياته في حديث حجة الوداع، وتوالت دعوات المفكرين والمصلحين في المطالبة بحماية حقوق الإنسان من القهر والاستغلال، إلى أن جاء الإعلان العالمي لحقوق الإنسان ليرسي قواعد صارمة بغية الحث على الحفاظ على حقوق الإنسان وعدم التفريط بها في حالات السلم والحرب. يأتي هذا البحث المتواضع لإلقاء الضوء على حماية بعض حقوق الإنسان في ضوء حديث الرسول (صلى الله عليه وسلم) في حجة الوداع، والمادة الثالثة للإعلان العالمي لحقوق الإنسان والتي تنص على أن لكل فرد الحق في الحياة والحرية وسلامة شخصه فيدرس الباحثان أهم الحقوق الواردة في الحديث النبوي والمادة المنوهة عنها أعلاه. تتوزع المادة العلمية للبحث على ثلاثة مطالب هي: المطلب الأول: دراسة حديث حجة الوداع. المطلب الثاني: دراسة المادة الثالثة للإعلان العالمي لحقوق الإنسان. المطلب الثالث: دراسة حماية حقوق الإنسان في ضوء حديث حجة الوداع والمادة الثالثة للإعلان العالمي لحقوق الإنسان. ويختتم البحث بذكر أهم النتائج والتوصيات.
Talking about human rights and his freedoms is a yesterday, today and tomorrow talking, And it is an instinct talking which hearts and souls receive with joy and pleasure, because the human soul eager to freedom and well-off, and there is no meaning of life without freedom and dignity. Holy Prophet (peace be upon him) has been put the basic rules of human rights and his freedoms in an argument Farewell Hadith, and the progression calls of thinkers and reformers claim the protection of human rights from oppression and exploitation, After that the Universal Declaration of Human Rights have come to establishes strict rules in order to urge the preservation of human rights and do not waste them in situations of peace and war. This modest research comes to shed light on the protection of some of human rights in the light of the Prophet (peace be upon him) Hadith during the argument Farewell, and the third article of the Universal Declaration of Human Rights which states that "Everyone has the right in life, liberty and security of person" the researchers studying the most important rights contained in the Hadith and the article which mentioned above. The scientific article of research distributed into three demands are:- The first demand: - Study of argument farewell Hadith. The second demand: - Study of the third article of the Universal Declaration of Human Rights. The third demand : - Study of human rights protection in the light of an argument farewell Hadith and the third article of the Universal Declaration of Human Rights .
