|a مع التطور الهائل لنشاط الإدارة وتدخلها في مجالات عديدة وتميزها بالسرعة، أصبحت رقابة المشروعية لا تؤدي الدور المنوط بها وذلك لعدم قدرتها على مواكبة سرعة تطور النشاط الإداري، ومن مميزات القضاء الإداري أنه قضاء إنشائي يعمد إلى ابتكار الحلول العملية لحماية حقوق وحريات الأفراد من تعسف الإدارة، وعلى الرغم من كون هذه الرقابة فعالة وتؤدي أغراضها المتمثلة في إلزام الإدارة على احترام مبدأ مشروعية في قراراتها. ورغم احترام الإدارة لهذه الأخيرة ظاهريا فقط، ولكن بالبحث في داخلية قرارات قد نجد أنها تخفي عيبا قد يؤثر على مصالح الأفراد.

|b With the tremendous development of management activity and its intervention in many areas and its excellence quickly, the supervision of legitimacy does not play the role assigned to it because of its inability to keep up with the speed of development of administrative activity. The advantages of the administrative judiciary is that it is a constructive judiciary that devises practical solutions to protect the rights and freedoms of individuals, Although such oversight is effective and fulfills its purposes of requiring the administration to respect the principle of legality in its decisions. Although the administration seems to respect the latter only ostensibly, but looking at internal decisions may find that they hide a defect that may affect the interests of individuals.
