|b This research aims to define the secret, it is the information that the person keens to withhold done the existence of a direct interest in keeping the secret under wraps and avoid it to be disclosed to any party because the declaration of the secret represents a material or moral damage infected without his will or desire. This research also aims to determine the rules of professional confidentiality, legal protection provided by the legislator, identify the elements of this protection, means and exceptions on them, the consequent different penalties depending on the type of crime and its effects and the types of criminals. In addition to practical cases which display conditions of permitted disclosure of professional secrets, and as the secret protects a legitimate interest, it requires a definition of this interest and the statement of sorts.

|a يهدف هذا البحث إلى تعريف السر بأنه المعلومة التي يحرص صاحبها على كتمانها لوجود مصلحة مباشرة في إبقاء سره طي الكتمان وتجنب إفشاؤه من أي جهة كانت لأن إعلان السر يشكل ضرراً مادياً أو معنوياً يلحقه دون أرادته أو رغبته. كما يهدف هذا البحث إلى تحديد ماهية السر المهني وقواعد الحماية القانونية التي وفرها المشرع وتحديد عناصر هذه الحماية ووسائلها والاستثناءات الواردة عليها، وما يترتب على ذلك من عقوبات مختلفة باختلاف نوع الجريمة وأثارها وأنواع الفاعلين لها. بالإضافة إلى عرض الحالات التي يباح فيها قانونيا إذاعة السر، وبما أن السر يحمي مصلحه مشروعة فإنه يستلزم تعريف هذه المصلحة وبيان أنواعها.
