|a أولت الشريعة الإسلامية اهتماما بالغا بالنسب، وعناية فائقة لذلك حضنته بتنظيم محكم من أجل تحقيق هدفين ساميين، يتجليان في المحافظة على طهارة الأنساب وأن يكون لكل إنسان نسب شرعي. ففي مجال إيجاد النسب ألغت كل مصادر النسب الباطلة، وقصرته على ما ينتج من زواج صحيح أو ملك يمين. وصونا له حرمت الزنا، لما قد يترتب عليها من اختلاط الأنساب، فلا يستطيع الإنسان أن يعرف أباه أو قرابته ..، بل ينشأ مقطوع النسب، من هنا ظهرت مشكلة كبيرة في نسب ولد الزنى. وعليه فإن هذه المسألة تعتبر من المسائل التي وقع فيها خلاف بين أهل العلم والتشريع الجزائري.
