المستخلص: حمل تخاذل الدول الأعضاء في المساهمة بالقدر الكافي من القوّات العسكرية في عملية حفظ السلام منذ نهاية الحرب الباردة منظّمة الأمم المتحدة إلى تغيير مُقاربتها بشكل جذري لإنفاذ مهامها ذات الصّلة بحفظ السلم والأمن الدوليين، ودفعها بالتالي إلى مُسايرة التوجّه السائد في الساحة الدولية الرامي إلى خصخصة السلم والأمن الدوليين. وبالفعل، شهِدَ اللّجوء إلى الشركات العسكرية والأمنية الخاصة في عمليات حفظ السلام الأممية نقلة نوعية خلال هذه الحِقبة الزمنية، وفي نفس الوقت حفيظة جانب من الفقه الدولي، في ضوء غياب تحديد دقيق لمفهوم هذه الكيانات، ولا حتى سندٍ قانوني واضح يُؤسّس إستخدامها في مواجهة الإنتقادات المُوجّهة لهكذا توظيف. هذا، ويُفهم الحذر الذي أبدته هذه الفئة من الفقهاء، خاصة إذا أخذنا بعين الإعتبار إتساع نطاق نشاط الشركات العسكرية والأمنية الخاصّة الذي طغى في بعض الحالات على الإختصاص الحصري للدول، بما أفضى على تجاوزات جسيمة لقواعد القانون الدولي من قِبل الأفراد الناشطين في هذه الشركات، وأثار في نفس الوقت مسألة نصيب المسؤولية الذي يتحمّله كل طرف من الأطراف الفَاعِلة في مثل هذه الحالات.

The failure of member states to contribute adequately to the military forces in the peacekeeping operations since the end of the cold war has led the United Nations Organization to radically change its approach to the implementation of its tasks related to the maintenance of international peace and security, and bring it consequently into line with the trend that impose itself in the international arena concerning the privatization of international peace and security. Indeed, the resort to private military and security companies in UN peacekeeping operations has witnessed a qualitative shift during this period of time, and led to the mistrust of a part from the international doctrine in light of absence of precise definition of the concept of these entities, nor even a clear legal basis for their use in front of the criticism directed at such practice. The caution of this parts of doctrine is understandable, especially given the wide scope of the activity of private military and security companies, which in some cases encroached the exclusive jurisdiction of states, leading to serious violations of the international law rules by individuals working in these companies, and raised at the same time the question of the share of responsibility that each of the actors in such cases would bear.
