المستخلص: نتناول في هذه الدراسة مسألة استئناف أحكام قضاء التعويض الإداري، وأثرها غير الموقف، وتداعيات ذلك على سير الإجراءات الخاصة بسحب التعويض المحكوم به لخصم الإدارة. معتمدين في ذلك على وقائع إحدى القضايا المجسدة لذلك في الواقع العملي. توصلنا إلى أن استئناف أحكام قضاء التعويض في المادة الإدارية، وعدم توقف تنفيذ الحكم المستأنف، أصبح إشكال كبير، يهدد المال العام من جهة، وكذا إثقال كاهل المواطن من جهة أخرى.

What is the benefit of appeal if the execution is not stopped in the administrative compensation district ? -The case of the Wali of Chlef State against K.s as a model- In this study, we address the issue of the appeal of the provisions of administrative compensation, its impact other than the position, and the implications of this on the conduct of procedures for withdrawal of compensation awarded to the management deduction. Relying on the facts of one of the issues embodied in practice. We found that the resumption of the provisions of compensation in the administrative article, and noninterruption of the implementation of the sentence appealed, became a major problem, threatening public money on the one hand, as well as burdening the citizen on the other hand.
