المستخلص: This study examined the right of a victim of trafficking in human beings, namely the right to remain in the receiving State when the victim is a foreigner. This issue was addressed through two chapters. the first dealt with the right of the victim to reside in the receiving country and the second right of the victim to remain by granting asylum status. The position of the Palermo Protocol on the prevention of trafficking, the position of European countries and the Jordanian law were also discussed in both chapters. Finally, the study reached a number of conclusions, notably that the Protocol of the prevention of human trafficking stipulated the right of the victim to stay in the territory of the receiving state on the basis of broad and loose terms leaving a broad discretionary margin for the state party in the mechanism of granting residence. The rights of the victim under the Prevention of Trafficking Protocol do not reduce his other rights guaranteed by the International Law such as his right to seek asylum and to benefit from the principle of the non-refoulement, however, it is challenging to implement this right in the countries that do not have a national asylum mechanism.

تناولت هذه الدراسة حقاً من حقوق ضحية الاتجار بالبشر، وهو الحق بالبقاء في الدولة المستقبلة عندما تكون الضحية أجنبية. تم معالجة هذا الموضوع من خلال مبحثين؛ الأول عالج حق الضحية بالإقامة في الدولة المستقبلة والثاني حق الضحية بالبقاء من خلال منحها صفة اللجوء. كما تم التطرق إلى موقف بروتوكول باليرمو الخاص بمنع الاتجار، موقف الدول الأوربية والقانون الأردني في كل من المبحثين. وفي الخاتمة توصلت الدراسة إلى مجموعة من النتائج، من أبرزها أن بروتوكول منع الاتجار نص على حق الضحية بالبقاء على إقليم الدولة المستقبلة بنصوص واسعة وفضفاضة، وترك هامشاً تقديرياً واسعاً للدولة الطرف في آلية منح الإقامة، وأن حقوق الضحية بموجب بروتوكول منع الاتجار لا تنتقص من حقوقه الأخرى المكفولة بموجب القانون الدولي مثل حقه بطلب اللجوء والاستفادة من مبدأ عدم الإعادة القسرية، إلا أن هناك صعوبة في تطبيق هذا الحق في الدول التي ليست لديها آلية وطنية للجوء.
