إن الشريعة جاءت لصالح العباد، وهي عدل الله بين عباده ورحمته بين خلقه، وظله في الارض وحكمته الدالة عليه، ولقد نظمت الشريعة علاقة المسلم بربه وعلاقته بالآخرين، وهذه العلاقة لابد أن تبنى على التعارف، قال تعالى: ﴿وَجَعَلۡنَٰكُمۡ شُعُوبا وَقَبَآئِلَ لِتَعَارَفُوٓاْۚ﴾، والتعارف هو سلوك سوي يشمل جميع التعاملات الاقتصادية والاجتماعية والثقافية، فإذا اختلت علاقة الناس بعضهم ببعض انتشر الفساد، وأصبح المرء غير آمن على دينه ونفسه وعرضه وماله، فعندئذ يتبدد احد أركان تطور العم ارن وهو الأمن ويسود المجتمع العنف والتطرف، والمقصد العام للشريعة عمارة الأرض، وحفظ نظام المواطنة والتعايش فيها. مشكلة البحث: وفي ظل التعددية العقدية والفكرية التي يعيشها العالم، والتي قد تكون في المجتمع الواحد نجد الضرورة ملحة للإجابة على التساؤلات الآتية: هل ضمن الإسلام لغير المسلمين حقوقهم في ظل النظام الاجتماعي؟ وهل يعترف الإسلام بحرية العقيدة لغير المسلمين؟ وما هي سبل التعايش التي شرعها الإسلام؟ أهمية البحث: تنبع أهمية البحث في هذا الموضوع من ناحيتين: الاولى: دفع توهم العنف والتشدد في النظام الإسلامي، والثانية: أنه يجلي بصورة واضحة ان نظام الإسلام نظام متكامل وصالح في كل مكان وزمان وان به ضمان لحقوق الانسان عموما. ومن النتائج التي توصلنا إليها الباحث أن سماحة الإسلام تتوافق مع رحمته وعالميته وواقعيته، إذ لا يسع دين العالم كله إلا إذا كان فيه من السماحة واليسر ما يتوافق مع طبيعة البشر على اختلاف ثقافاتهم وعاداتهم. لذا بيان فقه معاملة غير المسلمين وبيان سماحة الإسلام عبر وسائل الإعلام والمحاضرات والندوات والخطب والمواعظ، كما ينبغي تطبيق مبدأ حسن التعامل والحكمة في التعامل مع المخالفين في الدين، فبه يسعد البلد ويستتب الأمن، ويسلم من الانهيار والسقوط.
The Islamic law (Al-Sharia) exists for the benefit of worshipers. It is the justice and mercy of Alla among His creators and worshipers. It is also His shadow and wisdom on earth which denotes His existence. The Islamic law organizes the relationship of Muslim with his creator and others. This relationship builds on socializing. The Holy Quran says that “We created you from a single pair of a male and a female, and made you into nations and tribes, that ye may know each other”. Socializing is a normal behavior which covers all cultural, social and economic transactions. If the relationship between people is disturbed, the corruption will outbreak. Moreover, human beings will lose the security on their money, religion and themselves. So, if the security is lost, there will be no development in construction. The extremity and violence will be prevalent in society. This situation is not cope with the aim of Islam law which is the populating of the earth and protecting citizenship and coexistence. In the light of doctrinal and ideological pluralism which are rife in the world and it may be within one society, we find that there is an urgent need to the following questions: Does Islam guarantee the rights of non-Muslims under the social system? Does Islam acknowledge the freedom of thought for non-Muslims? What are the ways of coexistence which Islam has legislated? The importance of the study, in this subject originates from two aspects: First: denial of violence and extremity in Islam system. Second; it is clear that Islam system is a comprehensive system which can be applicable in every place and time because of its security and guaranty for human rights in general. Among the results that the researcher arrived at are the magnanimity of Islam copes with its mercy, globality and reality. These traits made Islam religion include all people in spite of their different cultures and traditions. Therefore, it is important to show the jurisprudence of transaction for non-Muslims and the magnanimity of Islam via social media, lectures, symposiums, orations and preaching. It is also important to apply the principle of good dealing and wisdom with those who have opposed views of religion. In doing so, the country will be prosperous and secure, avoiding falling and collapse.
