|a يناقش هذا البحث أحكام بناء أهل الذمة لكنائسهم وترميمها، وإعادة المنهدم منها، ملقيا الضوء على آراء الفقهاء في المسألة، حيث اختلفت الأحكام الفقهية المتعلقة ببناء الكنائس باختلاف الأماكن التي تبني فيها، ويناقش هذا البحث أراء الفقهاء المعاصرين في حكم بناء النصارى للكنائس في البلاد الإسلامية في عصرنا الحاضر، فحكم بناء الكنائس عند فقهائنا ليس جائزا بإطلاق، ولا ممنوعا بإطلاق، وسأبين في هذا البحث تقسيم الفقهاء السابقين للبلدان، وحكم بناء الكنائس في كل قسم منها، مع بيان ما اتفق عليه الفقهاء، وما اختلفوا فيه والرأي المختار في كل مسألة، وأبين بعد ذلك حكم بناء الكنائس في عصرنا الحاضر.

|b This study discusses the Islamic rules for building, rebuilding and restoring churches of the people of the Dhimma (non-Muslim citizens of an Islamic countries). Shedding the light on the opinions of Muslim jurisprudents about this issue from different aspects. We found that the jurisprudential rulings on building churches were varied significantly according to the whereabouts of churches will be built. This research also discusses the opinions of contemporary Muslim jurisprudents about building the Christian churches in current Islamic countries. In short, ruling on building churches among Muslim jurisprudents was not decisive in both cases of permitting or prohibition. During the study, Muslim countries and areas were identified and classified for different categories according to the previous Muslim jurisprudents. Then, the verdicts of building churches in each category was discussed based on Muslim jurisprudents’ consensus and dissensus, and their superior verdict on each case has been clearly demonstrated. Also, ruling on building churches in the present era was clarified.
