|a لقد كان من نتائج ظهور الاتجاهات الفلسفية والعلمية الحديثة، في مجال الفكر العقابي ومعاملة المساجين، إجماعها على إفلاس النظام العقابي القديم، القائم على الردع والعقاب في محاربة الإجرام، وإقرارها باعتماد المبادئ الإنسانية، والمعاملة الحضارية الراقية في التعامل مع المساجين، تحترم فيها كرامتهم وتصان آدميتهم كوسيلة لتوجيه سلوكهم وإرشادهم للعدول عن ارتكاب الجرائم. وعليه تحول اهتمام الفكر العقابي الحديث من معاقبة الفعل الإجرامي، إلى الاهتمام باستعمال الوسائل النافعة في معالجة الأسباب الدافعة إليه. ولمعالجة هذه الدوافع وتقويم سلوك الجاني ليصبح شخصا سويا يؤثر إيجابا في مجتمعه، عمد المشرع الجزائري في إطار إصلاح المنظومة العقابية إلى اعتماد أجهزة متخصصة عهد إليها مهمة تهذيب سلوك الجاني وتقويم تصرفاته من خلال آليات ووسائل حديثة تمكنها من القيام بمهامها لتحقيق هدف إعادة إدماجه بالمجتمع

|b It was the result of the emergence of modern philosophical and scientific trends, in the field of punitive thought and treatment of prisoners, its consensus on the bankruptcy of the old punitive system, based on deterrence and punishment in the fight against criminality, and its adoption of the principles of humanity, and civilized treatment of high in dealing with prisoners, respect their dignity and protect their humanity As a means of directing their behavior and guiding them to turn away from committing crimes. Accordingly, the attention of modern punitive thought has shifted from punishing the criminal act to the use of useful means in dealing with the reasons behind it. In order to deal with these motives and to evaluate the behavior of the offender to become a person together positively affect his society, the Algerian legislator in the framework of the reform of the penal system to the adoption of specialized organs entrusted with the task of refining the behavior of the offender and the evaluation of his actions through modern mechanisms and means to enable them to carry out their tasks to achieve the goal of re-integration with society.
