التاريخ حلقات متواصلة يكمل بعضها بعضا، فالماضي وسيلة لفهم الحاضر كما إن الحاضر يعيش فيه الماضي. وكلاهما يرسمان المستقبل. كما تعتبر حضارة بلاد الرافدين من أقدم الحضارات والتي سجلت وجودها التاريخي في كل من الجوانب الدينية والسياسية والاقتصادية والاجتماعية، وقد اهتمت تلك الحضارة بالحقوق العامة للإنسان. وهي تنص على العدالة والمساواة، إذ تعتبر العدالة والمساواة من أهم المبادئ التي نادت بها حضارة بلاد الرافدين كما ينبغي أن ندرك حرمان الإنسان من حقوقه أمر لا يمكن استبعاده طالما ظل الظلم من شيم بعض النفوس البشرية لكن مسيرة حقوق الإنسان في تاريخ البشرية حققت مكاسب كبيرة ويعود ذلك إلى نضال الأفراد والشعوب عبر التاريخ ضد الظلم والطغيان. كما إننا نجد الحضارة العراقية عبر حقبها التاريخية، قد شهدت مجموعة من التشريعات والإصلاحات المهمة، التي تطورت في مجال حقوق الإنسان، فكان لها دور بارز ومهم في إرساء القواعد الأولى لتلك الحقوق، وعليه سنتناول القوانين التي سبقت شريعة حمورابي من زوايا تأثيرها وتأثرها منها فقط تاركين الزوايا الأخرى من تلك القوانين إلى مواضيع التاريخ العام للقانون.
