المستخلص: This dissertation aims to highlight a sensitive point in the field of translation and foreign languages, which is represented in what is known as linguistic deficit, which often adversely affects the content of translation and puts it in most cases in second place, while the original text remains always in the forefront. Two may not differ if we declare that the transmission of the text from one environment to another causes it to clash with an endless set of barriers that impede its path and directly affect the pattern of editing the text in the target language. We also seek in this research paper to address the causes of linguistic deficit and concepts that do not accept the transition from one language to another. In this case, what means does the translator track so that he can do his work to the fullest? Perhaps the analysis of discourse would show us these barriers at the level of all types of texts in general, and the legal text in particular.

Cet article vise à faire la lumière sur un point sensible dans les domaines de la traduction et des langues étrangères, c’est celui du déficit linguistique, qui influence souvent sur la qualité du contenu de la traduction, ce qui la met dans la plupart des cas au second plan, tandis que le texte original reste toujours au premier plan. Cela peut ne pas être différent si nous disons que la transposition d’un texte d'un milieu à un autre le rend confronté à un nombre infini d'obstacles et influence directement sur la typologie de sa rédaction dans la langue cible. Nous cherchons également à aborder les raisons des déficits linguistiques et des concepts qui n'acceptent pas le passage d'une langue à une autre; dans ce cas, quelle démarche le traducteur suivrait-il pour accomplir sa tâche convenablement ? L'analyse du discours pourrait peut-être nous montrer ces obstacles au niveau de tous les types de textes en général et du texte juridique en particulier.

تهدف هذه المداخلة إلى تسليط الضوء على نقطة حساسة في ميدان الترجمة واللغات الأجنبية والتي تتمثل فيما يعرف بالعجز اللغوي، والذي كثيراً ما يؤثر سلباً على مضمون الترجمة ويدرجها في معظم الحالات في المرتبة الثانية، بينما يبقى النص الأصلي في الطليعة دائماً. وقد لا يختلف اثنان إذا صرحنا بأن انتقال النص من بيئة لأخرى يجعله يصطدم بمجموعة لا متناهية من الحواجز التي تعترض طريقه وتؤثر بصورة مباشرة على نمط تحرير النص في اللغة الهدف. كما نسعى في ورقتنا البحثية هذه إلى التطرق إلى أسباب العجز اللغوي والمفاهيم التي لاتقبل الانتقال من لغة إلى أخرى، وفي هذه الحالة ما هي السبل التي يتتبعها المترجم حتى يتسنى له القيام بعمله على أكمل وجه. ولعل تحليل الخطاب من شأنه أن يبين لنا هذه الحواجز على مستوى كل أنواع النصوص عموماً والنص القانوني خصوصاً.
