المستخلص: Any use of the protected work shall be considered lawful as long as it has been made within the legally permitted use. If otherwise, it would result in infringement of copyright requiring punitive protection (copyright); For this reason, Algerian and Jordanian legislators have relied on the criminalization of the infringement of the rights of the author. One of the most widespread forms of such offences is the offence of counterfeiting, and both legislators have defined the content of this offence and the penalties to be imposed in this case in order to put a speedy end to the infringement of copyright.

Toute utilisation du classifié protégés sont considérés légale tant que son utilisation est dans les normes autorisées par la loi, Et dans le cas échéant; elle est considérée comme une forme de violation du droit d'auteur; ce qui exige une protection pénale (copyright), c'est pour cette raison le législateur algérien et jordanien ont fourni une protection pénale du droit d'auteur sur la criminalisation de la violation sur les droits de ce dernier, et parmi les cas les plus répandus de ces crimes on trouve le délit de la contrefaçon, aussi bien les deux législateurs ont déterminé le contenu de ce délit ainsi classifié les sanctions relatives dans ce cas, de sorte à mettre une limite rapide à la violation des droits d'auteur.

يعتبر أي استخدام للمصنف المشمول بالحماية مشروعا ما دام قد تم ضمن الاستخدام المباح قانونا. أما إذا كان غير ذلك، فإنه يؤدي إلى تعدي على حقوق المؤلف يستوجب توفير حماية جزائية لها (حقوق المؤلف)، لذلك فقد اعتمد المشرع الجزائري والأردني في توفير الحماية لحقوق المؤلف على تجريم الاعتداء على حقوق هذا الأخير، ومن أكثر صور هذه الجرائم انتشار نجد جريمة التقليد، وقد حدد كلا المشرعين مضمون هذه الجريمة ورتب العقوبات المستوجبة في هذه الحالة حتى يضعا حدا سريعا للاعتداء على حق المؤلف.
