المستخلص: The development of the political embodiment of the modern state has been accompanied by many obstacles and many crises that have prevented the establishment of the philosophical principles on which the theory of the modern state was founded. These obstacles and crises of a legal and political nature have not only been a hindrance in the embodiment of the modern state and its goals, but also an obstacle to the effective relationship between the state and the individual, the State and civil society, the state and human rights.
No scholar or researcher in the development of the modern state can distinguish between the philosophical foundations of the modern state, namely, individual and collective freedoms, civil society, democracy, secularism, separation of powers, positive law, civil institutions... etc., the foundations of human rights are based. The evolution of the philosophical principles of the former embodies the creation of the latter, and the emergence of obstacles in the former necessarily affects the latter. But this relationship is often characterized by tension and conflict.
The question of the modern state and human rights remains at the core of modern philosophical and political discourse. Moreover, it is a very sensitive issue in view of the intellectual and ideological conflicts surrounding it and the controversy between the philosophy of human rights and the logic of the state, especially in the light of the crises experienced by the modern state and its impact on the implementation of human rights treaties and its protection from flagrant violations, on the one hand, and on the other, in light of the state's extension of the parameters of the embodiment and affirmation of power, or in the mechanisms used by the state to reproduce and consecrated power to the individual in particular and to society in general.

صاحب تطور التجسيد الساسي للدولة الحديثة العديد من العقبات والأزمات الكثيرة التي حالت تكريس المبادئ الفلسفية التي أسست عليها نظرية الدولة الحديثة. هذه العقبات والأزمات ذات الطبيعة القانونية والسياسية لم تكن فقط عائقا في تجسيد الدولة الحديثة والغايات التي تصبوا إليها، بل شكلت أيضا عائقا في تحقيق العلاقة الفعلية بين الدولة والفرد، الدولة والمجتمع المدني، الدولة وحقوق الإنسان.
لا يمكن لأي دراس وباحث في تطور الدولة الحديثة الفصل بين الأسس الفلسفية التي تقوم عليها الدولة الحديثة والمتمثلة في الحريات الفردية والجماعية، المجتمع المدني، الديمقراطية، العلمانية، الفصل بين السلطات، القانون الوضعي، المؤسسات المدنية.... الخ، والأسس التي تقوم عليها حقوق الإنسان، فتطور المبادئ الفلسفية للأولى جسد قيام الثانية، وظهور العقبات في الأولى يؤثر بالضرورة في الثانية. لكن هذه العلاقة تتسم في العديد من الأحيان بالتوتر والصراع.
إن مسألة الدولة الحديثة وحقوق الإنسان تظل جوهر الخطابات الفلسفية والسياسية الحديثة، وأكثر من ذلك فهي مسألة حساسة جدا نظرا الصراعات الفكرية والإيديولوجية التي تكتنفها، وفي الجدال بين فلسفة حقوق الإنسان ومنطق الدولة، خاصة في ظل الأزمات التي تعرفها الدولة الحديثة وتأثيراتها على مسار تطبيق معاهدات حقوق الإنسان وحمايتها من الانتهاكات الصارخة من جهة، ومن جهة أخرى في ظل بسط الدولة لمعالم تجسيد السلطة وتأكيدها، أو في الأليات التي تستخدمها الدولة في إعادة إنتاج السلطة وتكريسها على الفرد بصفة خاصة وعلى المجتمع بصفة عامة.
