المستخلص: This research focuses on the guarantees of the right to a fair trial in criminal matters as a fundamental human right. It is enshrined in all international covenants and penal legislation, which should be respected and guaranteed at the trial stage as a final and decisive stage for the accused and even for the rest of the parties to the criminal proceedings. As, it will be clear that the guarantees of this right derive their strength and support from the general principles of the judiciary, which guarantee criminal protection of human rights in general at all stages of penal follow-up.

L’objet de cet expose est les garanties de la poursuite pénale, cette droit est protégé par tous les chartes et les conventions du droits de Lhomme et législations pénales, notamment de savoir que cette étape est la fin et le dernier destin occasion devant l’accusé et les autres membres, de savoir que les garanties de protection de ce droit prennent la renforcement, et le soutien dans les principes générales du protection pénale des droits de Lhomme à toutes les étapes du poursuite pénale.

يتمحور هذا البحث حول ضمانات الحق في المحاكمة العادلة في المواد الجزائية كحق من حقوق الإنسان الأساسية، كرسته جميع المواثيق الدولية والتشريعات العقابية والتي ينبغي احترامها وضمانها في مرحلة المحاكمة كمرحلة أخيرة ومصيرية بالنسبة للمتهم وحتى بالنسبة لبقية أطراف الدعوى الجزائية، حيث سيتضح أن ضمانات هذا الحق تستمد قوتها ودعمها من المبادئ العامة للقضاء، التي تكفل الحماية الجزائية لحقوق الإنسان بوجه عام على مستوى كل مراحل المتابعة الجزائية.
