المستخلص: A fake marriage, the so-called imagery or white, is a marriage that is done only in order to obtain the most beautiful features of marriage, in the absence of any real intention to live together as a couple.
The marriage is based entirely on the consent of both parties, which is not based solely on statements made by the spouses before the civil status officer. Rather, it is necessary to refer to the real intention of marriage, which is based on the will of the husband to take the woman as his wife, the wife's intention to take the man as her husband, in marital cohabitation and in assuming duties.
Thus, the marriage contract must be consensual, as in the case of other contracts, and must be issued by a family, real and serious. Once there is consent and confirmation of the eligibility of the parties to the marriage contract, any problem arises about it leads us to talk about the fake marriage.

Le mariage simulé, communément appelé fictif ou blanc, est un marriage dans lequel au moins un des époux se marie uniquement pour obtenir un avantage lié au statut d'époux. C’est un mariage contracté en l'absence de toute intention matrimoniale.
Le mariage repose entièrement sur le consentement des époux. Ce consentement ne s'entend pas de la simple volonté de s'unir solennellement exprimée par les conjoints devant l'officier d'état civil. Il renvoie encore à l'intention matrimoniale, comprise comme la volonté de se prendre pour mari et femme, de se soumettre au statut d'époux et d'obéir aux devoirs qui en découlent.
Il est donc évident, à propos du mariage, ainsi qu'à l'instar des autres contrats, que le consentement doit exister, c'est-à-dire émaner d'une personne apte, et qu'il doit être réel et sérieux. Une fois la question de l'aptitude à consentir est mise de côté, l'existence du consentement nous amène à discuter de la notion du mariage simulé.

الزواج الصوري أو ما يسمى بالخيالي أو الأبيض هو الزواج الذي يتم من أجل الحصول على أحل مميزات الزواج فقط، في غياب كل نية حقيقية للمعاشرة كزوجين.
يرتكز الزواج كليا على رضاء الطرفين، الذي لا يقوم بناء على مجرد تصريحات الزوجين أمام ضابط الحالة المدنية، بل يجب الرجوع إلى نية الزواج الحقيقية، التي تقوم على إرادة الزوج في اتخاذ المرأة زوجة له، ونية الزوجة في اتخاذ الرجل زوجا لها، وفي المعاشرة الزوجية وفي تحمل الواجبات.
وبالتالي فإنه يجب التراضي في عقد الزواج كما هو الحال بالنسبة لبقية العقود، وأن يكون صادرا عن شخص آهل، وأن يكون حقيقيا وجديا، وبمجرد وجود الرضاء والتأكد من أهلية الأطراف في عقد الزواج فإن أي إشكال يطرح بخصوصه يقودنا إلى الحديث عن الزواج الصوري.
