المستخلص: If regional decentralization as one of the methods of administrative organization is based on the idea that competencies are distributed between the government in the capital and the territorial units. Under this method, the territory of the state is divided into territorial units with a person of moral character. Each unit is managed by an elected local council, subject to the control of the central authority. The Algerian legislator has adopted the democratic principle in forming local councils — municipal and state — to ensure their independence. If the independence of local people's councils, which is one of the consequences of the recognition by the legislator of municipalities and states of legal personality, we find that all the members of the Municipal People's Assembly and all the members of the State People's Assembly, including the Presidents of both Houses, are elected by the municipal and state residents registered on the voters list.
Accordingly, the position of the Algerian legislator to involve citizens in the management of their local affairs is essential and is required by the principles of democracy on the one hand, on the other hand, it helps to raise awareness and the importance of teamwork and train citizens in local administration and responsibility.

La décentralisation territoriale en tant que technique de organization administrative repose sur l'idée de la répartition des compétences entre le gouvernement de la capitale et les unités territoriale. Selon cette méthode, le territoire de l'État est divisé en unités territoriales dotées d'une personnalité morale et l'administration de chaque unité d'un conseil local élu est soumise au contrôle de l'autorité centrale.
Les législateurs algériens ont pris le principe démocratique de former des conseils locaux - municipaux et étatiques - pour assurer leur indépendance. Si l'indépendance des conseils locaux est une des conséquences de la reconnaissance de la personnalité et de la morale par le législateur, tous les membres de l'Assemblée populaire de la commune et tous les membres de l'Assemblée populaire de la wilaya sont élus par les habitants de la municipalité et inscrits sur la liste électorale.
Par conséquent, l'implication des citoyens dans la gestion de leurs affaires locales est essentielle d'une part aux principes de la démocratie et d'autre part à la sensibilisation et à l'importance de l'action collective et à la formation des citoyens aux affaires de l'administration locale.

إذا كانت اللامركزية الإقليمية باعتبارها أحد أساليب التنظيم الإداري تقوم على فكرة مفادها توزيع الاختصاصات بين الحكومة في العاصمة والوحدات الإقليمية. وبمقتضى هذا الأسلوب يقسم إقليم الدولة إلى وحدات إقليمية تتمتع بشخصية معنوية، ويقوم على إدارة كل وحدة مجلس محلي منتخب على أن تخضع هذه المجالس لرقابة السلطة المركزية فإن المشرع الجزائري أخذ بالمبدأ الديمقراطي في تكوين المجالس المحلية – البلدية والولائية – لضمان استقلالها. فإذا كان استقلال المجالس الشعبية المحلية الذي هو أحد النتائج المترتبة على اعتراف المشرع للبلديات والولايات بالشخصية المعنوية، فنجد أن كل أعضاء المجلس الشعبي البلدي وكل أعضاء المجلس الشعبي الولائي بمن فيهم رئيسي المجلسين، يتم انتخابهم بواسطة سكان البلدية والولاية المسجلين في قائمة الناخبين.
وعليه فإن موقف المشرع الجزائري من خلال إشراك المواطنين في إدارة شؤونهم المحلية أمر ضروري تتطلبه مبادئ الديمقراطية من جهة، ومن جهة ثانية فإنه يساعد على نشر الوعي وأهمية العمل الجماعي وتدريب المواطنين على شؤون الإدارة المحلية وتحمل المسؤولية.
