لقد ساهم التطور التقني الحاصل في صناعة الطائرات إلى ارتفاع قيمتها الاقتصادية تفوق في أغلب الأحوال قيمة العقارات من جهة، وتعزيز التبادل التجاري بين الدول من جهة أخرى. فكان أمام هذا النشاط الحيوي أن لجأت تشريعات الدول ومن قبلها الاتفاقيات الدولية إلى التفكير في استحداث صيغ قانونية ائتمانية لتسهيل تمويل شركات النقل الجوي التي ترغب في توسيع أسطولها الجوي عبر اقتناء مزيد من الطائرات، إما لغرض الاستبدال أو لغرض الزيادة من أجل فتح خطوط نقل جديدة. وقد انتهى الأمر إلى إقرار رهن غير حيازي على الطائرة باعتبارها أكثر المنقولات موافقة وملائمة لهذا النوع الجديد من الرهن. Le développement technique se déroulant dans l'industrie aéronautique a contribué à la forte valeur économique dépassé dans la plupart des cas, la valeur des biens immobiliers d'une part, et la promotion des échanges commerciaux entre les pays de l'autre. Il était en face de cette activité vitale qui ont eu recours à la législation des Etats et accepté par les conventions internationales à envisager l'introduction de formules juridiques de crédit pour faciliter le financement des entreprises de transport aérien qui souhaitent étendre sa flotte par l'acquisition de plusieurs appareils, que ce soit dans le but de remplacer ou dans le but de l'augmentation afin d'ouvrir de nouvelles lignes de transmission. Il a fini par un engagement sans dépossession sur l'avion comme transfert le plus approuvé et approprié de ce nouveau type de forclusion. The technical development that has occurred in respect to the production of airplanes has contributed to raising their economic value, surpassing the value of real estate in mots cases, on the one hand, and to increased trade between countries on the other. In the face of this vital activity, the legislation of States, in addition to prior international conventions, resorted to contemplating the introduction of legal credit formulas to facilitate the financing of air carriers that wish to expand their air fleet by acquiring more aircraft; either for the purpose of replacement or to increase them in order to open transport new lines. The matter culminated with the sanction of non-acquisition security upon the aircraft regarding them to be the most agreeable and appropriate movables for this new type of security.
