المستخلص: المضمون والأهداف: تشتغل هذه الدراسة بمسألة الوقف الذري في ضوء التنقيح باعتباره من أدوات النظر في الفروع، ومسبار الجودة في التحرير وإعادة التحرير، فبينه وبين الامتياز في التأليف علاقة طردية؛ كلما توسعت دوائر التنقيح نهضت الكتابة وسددت الفتوى، ومن أهداف هذه الدراسة: - تحديث النظر في الفروع بطريقة المتقدمين في التنقيح مع توسع في العرض التجريدي للمسألة على أصول وقواعد ونظريات الاستدلال. - التنبيه إلى أهمية اختبار وإعادة تركيب جزيئات الفروع في ضوء الواقع؛ لذلك انتخبت مسألة الوقف الذري؛ لكونها من المسائل التي أفرزت إشكالات في التطبيق والممارسة. - التنبيه إلى دور المصطلح في رسم الصورة الأولية للمسائل وانعكاس ذلك على سداد الفتوى فيها. المنهج: اعتمد البحث منهجيات الوصف والتجريد والتحليل والمناقشة، واستظهرت فقرات الدراسة بصياغة تستشرف الإضافة العلمية في إعادة قراءة الفروع وتنزيلها في الواقع، ووسعت الحديث في جزيئات المسألة لتترجم عن طرائق التنقيح وأدواته. النتائج والتوصيات: بلغ البحث نتائج أهمها: تأثير المصطلح في استشكال بعض صور الوقف الأهلي، وكذلك تداخل الجزئيات المكونة للاستدلال على مشروعيته؛ وضرورة تحرير المصطلح أولا. وأهمية فصل أجزاء المسألة وتصنيف الوقف الذري بناء على تعريف حدي يصدق على صفته، كذلك أهمية بيان أن إطلاق القول بنفي مشروعية الوقف الذري تجاوز لمنهجية الاستدلال، وتصحيح كل صوره تجاوز كذلك من وجه آخر. ثم التنبيه إلى تجاوز السائد في الجزم بمشروعية كل صور الوقف الذري، وتمييز ما يوافق الأصول والمقاصد وما يخالفها.

This research searches about the matter of Family Waqf in the method of revision as it is considered an important tool for searching in the branches and a good criterion in editing and reediting. The relationship between this method and the advantage of authorship is extrusive. Whenever the scope of revision increases, the writing develops and the Fatwa become more accurate. Among the objectives of this research are: - Renewing researching in the fiqh branches in revision as the method of early scholars, and widening the mere presentation for the matter in the principles and theories of inference. - Referring to the importance of testing and reconstructing the fiqh branches according to the real case. For that, the matter of Family Waqf has been chosen since it is one of the problems, which has produced problems in practice and application. - Referring to the role of term in drawing the preliminary picture of matters and its effect on the accuracy of Fatwa related to these matters. Methodology The research adopts the methods of description, clarification, analysis and discussion. The sections of the study have been formed in a way that look forward to the scientific addition in rereading the branches and applying them in the real. The researched matter has been studied in detail to clarify the methods of revision and its tools. Results and Recommendations The main important results the research has achieved are demonstrating the following: - The effect of the term in confusing some forms of Family Waqf. - Also, the overlapping of the components which implicit the inference on the legality of the term, so it was ought firstly to free the term. - In addition, the importance of separating parts of the matter and classifying the Family Waqf based on specified definition coincide with its adjective. - Furthermore, the importance of stating that the opinion prohibiting the legality of Family Waqf in absolute contradicts the methodology of inference; and the permitting of all Family Waqf forms is also not fair. - Finally, the indication to exceeding the prevailing saying, which legislate all forms of Family Waqf, and distinguishing between what is corresponding to the principles and purposes of the Law and what is contrary to them.
