تهدف هذه الدراسة إلى بيان حجية مفهوم الموافقة عند الأصوليين، وأثرها في اختلاف الفقهاء، من خلال الإجابة على إشكالية الدراسة المتمثلة في أسئلة ثلاثة أهمها ما طبيعة مفهوم الموافقة عند الأصوليين، وهل أثرت في اختلاف الفقهاء، وما هي التطبيقات المعاصرة لها في باب العبادات، وقد اعتمد الباحثان في الإجابة على هذه الأسئلة على المنهج الاستقرائي والتحليلي والاستنباطي، حيث سيتم استقراء الآراء المتعلقة بمفهوم الموافقة، والبحث في كل ما له علاقة بموضوع الدراسة، ومن ثم تحليل النصوص وإرجاعها إلى أصولها الشرعية وتحليل الآراء الأصولية المتعلقة بموضوع الدراسة، ومن ثم دراسة الآراء الأصولية المختلفة في المسألة الواحدة والنظر في الأدلة، ثم الترجيح بينها، بناء على قوة الدليل ما أمكن. وقد توصلت الدراسة إلى نتائج عدة من أهمها: ١. مفهوم الموافقة يعني: دلالة اللفظ على ثبوت حكم المنطوق به للمسكوت عنه وموافقته له نفياً وإثباتا لاشتراكهما في معني يدرك بمجرد معرفة اللغة دون الحاجة إلى بحث واجتهاد، وتمثل مصدر التجدد في الفقه الإسلامي، وروح النص والشريعة، وتكون قطعية أو ظنية. ٢. ظهر أثر مفهوم الموافقة في اختلاف الفقهاء في العبادات في المسائل المعاصرة. وقد اشتملت هذه الدراسة على مقدمة وثلاثة مباحث على النحو الآتي: المبحث الأول: تعريف مفهوم الموافقة وأسمائها وحجيتها عند الأصوليين. المبحث الثاني: طبيعة دلالة مفهوم الموافقة على الحكم وأقسامها عند الأصوليين. المبحث الثالث: التطبيقات المعاصرة لمفهوم الموافقة في العبادات "استخدام الصائم اللصقات والمراهم الجلدية".
The purpose of this study is to explain the validity of the concept of approval among the fundamentalists and its impact on the difference of jurists by answering the problem of the study, which consists of three questions, the most important of which is the nature of the concept of approval among the fundamentalists. The researcher will answer the questions on the inductive, analytical and deductive approach, where the opinions on the concept of approval, research on everything related to the subject of the study will be extrapolated, and then analyze the texts and return them to their legal origins and analyze the fundamental views on the subject of study, And then study different fundamentalist views on one issue and consider the evidence, and then weighting them, based on the strength of the evidence whenever possible. The study reached several results, the most important of which are: 1-The concept of consent means: the meaning of the word on the provenance of the operative sentence to silence and consent to it and the denial and proof of their participation in the meaning realized by the knowledge of the language without the need for research and diligence, and the source of renewal in Islamic jurisprudence, and the spirit of the text and the law, and be peremptory or hypocritical. -2The effect of the concept of consent in the difference of jurists in the acts of worship in contemporary matters has emerged. This study included an introduction and three questions as follows: The first topic: Definition of the concept of consent and its names and the Hijjah at fundamentalists. The second topic: the nature of the significance of the concept of approval of the ruling and its divisions among the fundamentalists. The third topic: contemporary applications of the concept of approval in worship "the use of fasting plasters and skin ointments".
