|b It is important to know that the absolute divorce is one of the ways of dissolving the marriage contract, and it is signed by the couple in front of the judiciary or the legitimate ruler in exchange for a payment paid by the wife to her husband to divorce her. Furthermore, based on the importance of this subject in the practical life, therefore the study gave it a great interest, this study is considered as a stage of education for the rights of the woman which were guaranteed by Islam, and without any doubt it related to the subject under discussion, especially with the existence of many things that were revealed by the study. Therefore, this subject dealt with in three points: The researcher devoted the first one to the concept of the absolute divorce including its linguistic and constitutional definition, as well as the legitimate evidence of the Holy Quran and the Sunnah. The second one was about the historical origin of the absolute divorce among Arabs before the Mission of the prophet Muhammad (P.C), and we also discussed the rules of the absolute divorce. And as for the third one, the researcher dealt with its kinds as well as its effects.

|a من المهم معرفة أن الطلاق الخلعي يعد أحد طرائق انحلال عقد الزواج، ويقع باتفاق الزوجين أمام القضاء أو الحاكم الشرعي مقابل عوض تدفعه الزوجة لزوجها لإنهاء عقد الزواج، وانطلاقا من أهمية هذا الموضوع في الحياة العملية فقد أولته الدراسة اهتماماً كبيراً، فهذه الدراسة هي مرحلة تثقيفية بحقوق المرأة التي كفلها الإسلام لها، ومنها بلا شك ما يتعلق بالموضوع قيد البحث، لا سيما مع وجود أمور مغيبة كشفتها الدراسة، وقد تناولنا هذا الموضوع في ثلاثة مطالب، خصصنا المطلب الأول لمفهوم الطلاق الخلعي وبينا فيه تعريفه اللغوي والاصطلاحي، وأدله مشروعيته من القرآن الكريم والسنة المحمدية، والمطلب الثاني جاء فيه الأصل التاريخي للطلاق الخلعي عند العرب قبل البعثة المحمدية، وبحثنا فيه أيضاً أركان الطلاق الخلعي، وتناولنا في المطلب الثالث أنواع الطلاق الخلعي وما يترتب عليه من آثار.
