المستخلص: In view of the nature of texts with respect of stability and the elucidation techniques as expressed by the Arabs tongue, and what is overwhelmed by probabilities either from the part of utterance or content, and the variation of the intention assessment as basis or application on the particulars, this has been the difference assumption in the jurisprudence methodologies and the comprehension of the legislator's objective. Through its texts. This study has come to show the jurisprudent methodologies in general on which the contemporary Islamic jurisprudence is based to show the regeneration, scattering and rigidity features so that we can promote jurisprudence to become a pioneer in solving the nation's problems. This study also shows the objective causes which are responsible for the multiplicity of the jurisprudent methodologies for understanding the situation at a high level of awareness and rationality for dealing with the differences and the argument shall be based on evidence and proof and not on defamation and denial. The study has not overlooked the assessment of the jurisprudent and showing the feature of every methodology as well its merits and demerits for benefiting from each of them and enhancing the positive aspect in each of them. This study also shows the objective reasons that led to the multiplicity of jurisprudential approaches to understanding the situation at a high level of awareness and guidance in dealing with differences, and the argument is based on argument and proof, not defamation and denial, and did not neglect the head of the evaluation of jurisprudential curricula and the features of each curriculum, Pros and cons to be utilized all of them, and enhance the positive side of each.

نظراً لطبيعة النصوص من حيث الثبوت، وأسلوب البيان الجاري على وفق لسان العرب، وما يحتف به من الاحتمالات سواء من حيث اللفظ أو السياق، واختلاف التقدير المقاصدي تقعيداً وتطبيقاً على الجزئيات فقد كانت هذه مظنة الاختلاف في مناهج التفقه لفهم مراد الشارع من خلال نصوصه، وتأتي هذه الدراسة لتبين المناهج الفقهية بصورة عامة والتي يقوم عليها الفقه الإسلامي المعاصر لتبين ملامح التجديد، وملامح التبديد، وملامح الجمود، حتى ننهض بالفقه؛ ليكون رائدا في حلول مشاكل الأمة المعاصرة في مختلف جوانب الحياة. كما تبين هذه الدراسة الأسباب الموضوعية التي كانت سببا في تعدد المناهج الفقهية لفهم الحال على مستوى عال من الوعي والرشد في التعامل مع الاختلافات، ويكون الجدل على أساس الحجة والبرهان لا التجريح والإنكار، ولم تغفل الدراسة تقييم المناهج الفقهية وبيان ملامح كل منهج، وما فيه من المحاسن والمثالب ليتم الاستفادة منها جمعيا، وتعزيز الجانب الإيجابي من كل منها.
